Forced to eat beef, NRI's wife gets divorce

MUMBAI: A man forcing his traditional Indian wife to consume beef, pork and alcohol, forcing her to pose in skimpy clothes and uploading such photographs on a website amounts to cruelty, the Bombay high court has decreed. A division bench of Justice P B Majumdar and Justice R V More on Friday upheld a family court order allowing a Ghatkopar resident to divorce her US-based husband.

"This is an eye-opener for parents whose daughter is going to marry a person settled in a foreign country," said the judges. "In such cases they are required to take appropriate care to find out the credentials of the person who has settled in the other country. If the matrimonial knot is tied without proper verification, it may result in serious difficulties, as has happened in the present case."

Naina, 32, married California resident Ritesh Karnik (36) in June 2002 in Nashik according to Hindu Vedic rites and moved to the US with him. Their marital bliss did not last long, with Naina returning to India within seven months and filing for divorce.

The aggrieved wife claimed that after reaching the US, Ritesh insisted on her discarding her traditional lifestyle for the American one. He made her cut her hair and eat beef and pork, even asking her to cook meat on days when she was fasting, "showing no respect for Gods and Hindu deities". When she refused, he would deny her money to buy Indian food, and she had to survive on bread and jam. Her other grievances: on a trip to Hawaii, Ritesh forced her to wear "short and vulgar dresses", "mix with boys and girls in parties" and later uploaded her photographs on websites.

Ritesh's lawyers, while denying that he had uploaded her photographs, argued that there was no cruelty in asking one's wife to cook a certain food or wear a particular kind of outfit. "Naina married Ritesh with the full knowledge that she was required to settle in America. Consequently she cannot make any complaints regarding the lifestyle which she was required to follow," Ritesh's advocate contended, adding that she was expected to "adjust" to the environment of the new country.

The judges, however, did not buy this argument. "It is not expected from Naina to sacrifice her own culture and adopt an atmosphere which may not suit a lady (brought up in a) different Indian culture altogether," remarked the court. "To ask a wife to wear a particular type of outfit or compelling her to take wine or alcohol, in our view, can be said to be an act of cruelty to the wife. Even if the husband compels the wife to mix with his friends when she is unwilling, it would also amount to cruelty to her." The judges also took a strong view of Naina's allegation that her photographs in short dresses of the couple's trip to Hawaii were uploaded on websites under fake profiles. "Normally no wife will tolerate the projection of her photographs on websites," the judges said.

Naina told the court that she did not want any maintenance from Ritesh. During the hearing of the appeal, Ritesh offered divorce if Naina withdrew all the criminal cases she had registered against him under the cyber crime laws for allegedly uploading her photographs. Naina refused. The court also rejected Ritesh's plea for a retrial in the family court — Ritesh had said that while he would not come to India, his mother should be allowed to testify on his behalf.

நெல்லையில் தேவேந்திரகுல வேளாளர் அமைப்பினரை ஆதிதிராவிடர் இன பட்டியலில் இருந்து நீக்கி தனிப்பட்டியலில் சேர்க்க வலியுறுத்தும் ஆலோசனை கூட்டம் நேற்று நெல்லையில் நடந்தது. தேவேந்திர குல வேளாளர் சங்க தலைவர் பசுபதிபாண்டியன் தலைமை வகித்தார். தமிழக சிறுசேமிப்பு துறை இயக்குநரும் நெல்லையை சேர்ந்தவருமான உமாசங்கர் ஐ.ஏ.எஸ்.,பேசுகையில், சுதந்திரம் அடைந்து 62 ஆண்டுகள் ஆகியும் நம் இனத்தவர்கள் இன்னமும் அடிமையாகத்தான் உள்ளார்கள்.


அரசு பணிகளில் இருந்தாலும் மற்றவர்கள் அடிமையாகத்தான் பார்க்கிறார்கள். ராஜஸ்தான் மாநிலத்தில் ஒரு இனத்தவர்கள் தங்களை எஸ்.சி.,பட்டியலில் சேர்க்க வலியுறுத்தி போராடுகிறார்கள். இந்த பட்டியலில் இருந்தால் என்ன பாதிப்பு என்று நமக்குத்தான் தெரியும். நான் ஜாதி தலைவர்களையோ, அரசியல் தலைவர்களையோ குறைசொல்ல விரும்பவில்லை. இரண்டு கோடி பேர் தாழ்த்தப்பட்ட மக்கள் இருந்தும் ஒரு தொழிலோ, ஒரு வியாபாரமோ செய்யவில்லை.

யாரைக் கடித்து குதறலாம் என்று நாக்கை தொங்கவிட்டுக்கொண்டு உலகை வலம் வரும் அமெரிக்க ஏகாதிபத்தியத்தியம் என்கிற‌ வெறி நாயின் நடு மண்டையில் விழுந்த கல்ல‌டியாய் 9/11 குறிக்கப்படும்.

செப்டம்பர் 11, பார்ப்பனிய கட்டமைப்பில் உள்ள இந்தியாவில் பார்ப்பனியத்தை நடைமுறையில் உயிர்ப்புடன் வைத்திருக்கும் ஆதிக்க சாதி இந்துக்களுக்கெதிராக போராடி தன் இன்னுயிரை நீத்த பார்ப்பனீய எதிர்ப்பு போராளி இம்மானுவேல் சேகரன் தன் குருதியை விதையாய் விதைத்த நாள்.

1957ம் ஆண்டு செப்டம்பர் மாதம் 10ம் நாள், தென்மாவட்டங்களில் அப்போது நடந்த தேர்தலுக்கு பின் நடந்த ஆதிக்க‌ சாதி ஒடுக்குமுறையின் மீது அமைதியை(!) நிலைநாட்ட இராமநாதபுரம் ஆட்சியரால் கூட்டப்பட்ட அமைதிப் பேச்சுவார்த்தை கூட்டத்தில் வெவ்வேறு சமூகத்தை (சாதி) சேர்ந்த தலைவர்கள் அழைக்கப்பட்டிருந்தனர். அக்கூட்டத்திற்கு ஒடுக்கபட்ட மக்களின் பிரதிநிதியாக,தலைவராக‌ இம்மானுவேல் சேகரனும் அழைக்கப்பட்டிருந்தார். இது பார்ப்பனியத்தின் அடியாளான முத்துராமலிங்கத்துக்கு பொறுக்குமா ? பொறுக்கவில்லை, இம்மானுவேலை எப்படி இந்த கூட்டத்திற்கு அழைக்கலாம், இம்மானுவேல் தனக்கு சமமான தலைவனா என்றெல்லாம் கொதித்து போய் கேள்வி எழுப்பினார்.இதற்கு தியாகி இம்மானுவேல் சேகரன், தான் தேவருக்கு சமமான தலைவனா இல்லையா என்பதைப் பற்றி தன்னை தலைவனாக ஏற்றுக்கொண்ட ஒடுக்கப்பட்ட மக்களுக்குத் தெரியும் என்று பதிலளித்தார். கூட்டத்திலிருந்து கடுகடுவென்று வெளியே வந்த முத்துராமலிங்கம்,தாழ்த்தபட்ட சமூகத்திலிருந்து வந்த ஒருவன் தனக்கு சரிசமமாக காலுக்கு மேல் கால் போட்டு உட்கார்ந்து பேசுகிற அளவிற்கு வளரவிட்டு விட்டீர்களே என்கிற தனது சாதிவெறியை தொண்டர்களிடம் கொட்ட‌.அந்த கோபத்தை தணிக்கும் பொருட்டு அடுத்த நாளே (செப்டம்பர் 11ம் நாள்) தேவர் சாதிவெறியர்கள் இம்மானுவேல் சேகரனை கொடூரமாக வெட்டி சாய்த்தார்கள்.தியாகி இம்மானுவேல் சேகரன் அவர்களின் 52ம் ஆண்டு நினைவு நாளையொட்டி பரமகுடியில் இவ்வருடமும் நினைவஞ்சலிக்காக ஆதிக்க சாதிக்கெதிரான தன் வலிமையை காட்டும் குருபூஜைவிழா 11-09-09 அன்று நடைபெற்றது.

மதுரையில் இருந்து சுமார் 75 கி.மீ தொலைவில் உள்ள பரமகுடியில் இவ்விழா வருடந்தோரும் நடைபெறுகிறது. மதுரையிலிருந்து பரமகுடி நோக்கி போகும் வழி நெடுகிலும் மக்கள் கட்டியெழுப்பியுள்ள பிளெக்ஸ் பேனர்களில் தியாகி இம்மானுவேல் சேகரன் கம்பீரமாக வரவேற்கிறார்.அம்மாவீரனின் கம்பீர தோற்றம் ஒடுக்கப்பட்ட மக்கள் அனைவருடைய உள்ளத்திலும் ஒன்று குவிந்துள்ள ஆதிக்க சாதிகெதிரான சினமாக‌ காட்சியளிக்கிறது.

நினைவஞ்சலி செலுத்த வரும் மக்கள் வண்டிகளில் வரும் போது சில அவசர காரியமாக‌ மரத்தின் ஓரமாக‌ வண்டியை நிறுத்தினாலும் காவல் துறையினர் கலகலத்து போய் விடுகிறார்கள்.ஆளும் வர்க்கத்தின் ஏவல் ஆட்களான இந்த காவல்துறையினர் ஆதிக்க சாதி பெரும்பாண்மையினர்‌ வாழும் ஊர்களின் எல்லைகளிலும், முத்துராமலிங்கத்தின் சிலையை சுற்றிலும் கண் இமைக்காமல் காவல் காக்கின்றனர். தலித் மக்கள் அவ்வூர்களில் எல்லாம் நுழைந்து கலகம் செய்வதற்காகவே வருவது போலவும் அதை தடுப்பதற்காகவே இவர்கள் இருப்பது போலவும் சிறப்பு அதிரடி படை,அந்த படை,இந்த படை என்று பரமகுடியை சுற்றி குவிந்து கிடக்கிறார்கள். இந்த‌ காவல்துறை அடிமைகள் முத்துராமலிங்கத்தின் குருபூஜை நடக்கும் போதும் பாதுகாப்புக்கு(!) வருவார்கள். ஒடுக்கபட்ட மக்கள் மீது வன்மத்தை செலுத்துவதில் வெறி கொள்ளும் ஆதிக்க சாதி வெறியர்கள் தாங்கள் செல்லும் வழிகளில் எல்லாம் ஓநாய்களைப் போல தமது இரத்தவெறிக்கு தாழ்த்தபட்ட மக்கள் வாழும் ஊர்களில் புகுந்து நாசம் செய்யும் போது மட்டும் கிராபிக்ஸ் காட்சி மாதிரி காணாமல் போய்விடுவார்கள்.

தியாகி இம்மானுவேல் சேகரன், அண்ணல் அம்பேத்கரின் உருவம் பொறித்த நுழைவு வளையத்திலிருந்துபரமக்குடி துவங்குகிறது. அங்கிருந்து சுமார் 3கி.மீ தொலைவில் நினைவிடம் உள்ளது.ராணுவ உடையில் காட்சியளிக்கும் அம்மாவீரனின் அணியில் இளைஞர்கள் சேருவது போல் நினைவிடத்தை நோக்கி அணி வகுத்து செல்கின்றார்கள். பல கிராமங்களில் உள்ள பல்லாயிரக்கணக்கான மக்கள் ஆண்டாண்டு காலமாய் ஆதிக்க சாதி வெறியர்களால் ஒடுக்கபட்டும் நசுக்கப்பட்டும் வருகிறார்கள். சிதைக்கப்படும் தமது வாழ்க்கை பற்றி உள்ளத்தில் புகைந்திருக்கும் தன் உள்ளக் குமுறல்களை, உணர்ச்சியை சிலம்பாட்டம், தப்பாட்டத்துடன் கூடிய கிராமிய கலையில் வெளிப்படுத்துகிறார்கள். ஆதிக்கத்தை எதிர்த்து தன் இன்னுரை நீத்த ஈகைக்கு நன்றி செலுத்தும் நாளாக இவ்விழாவில் பால் குடம் ஏந்தி தன் குடும்பத்துடன் கலந்து கொள்கின்றனர்.

ஒடுக்கு முறைகளுக்குள்ளாகும் இம்மக்கள் தமது அவலங்களுக்கெல்லாம் தீர்வு என்ன என்று திக்குத்தெரியாமல் தவிப்பது அவர்களின் முகத்தில் தெரிகிறது. ஆனால் அவர்களின் அவலங்களை தன் கட்சியின் விளம்பரத்திற்காகவும், அவர்களின் ஓலங்களை தன் கட்சியின் ஒலிபெருக்கிக்காகவும் பயன்படுத்தி தேர்தலில் ஆளும் வர்க்கத்துடனும்,ஆதிக்க சாதி வெறியர்களுடனும், ஓட்டு பொறுக்கி அரசியல் கட்சியினருடனும் தஞ்சம் அடைந்த தலைவர்களோ மக்கள் நடந்து செல்லும் வழி முழுதும் தியாகி இம்மானுவேல் சேகரன் பேனரில் பளிச்சென பல்லிளித்து போஸ் கொடுக்கிறார்கள். ம‌க்கள் அதையும் பார்த்து எந்த உணர்ச்சியுமற்று கடந்து தான் செல்கிறார்கள். தன்னை ஆண்ட பறம்பரை என்று கூறும் ஆதிக்க சாதியினரிடம் அடிமைசாதியாய் ஒருபுறம். தன்னை வைத்து அரசியல் வியாபாரம் செய்யும் தனக்கான தலைவனிடம் தான் அடிமை என்று உணராமலேயே அடிமையாய் இருப்பது மறுபுறம். இதுதான் இன்று தாழ்த்தபட்ட மக்களின் நிலை, மிகவும் அவலமான‌ நிலை.

இப்பெல்லாம் யார் சார் சாதி பார்க்கிறார்கள் என்று அப்பாவித்தனமாய் (!) கேட்பவர்க‌ளும், மக்கள் போராடுவதற்கு தயாராக இல்லை என்றும் அரசு தான் எதையாவது பார்த்து செய்ய வேண்டும் என்று அரசிடம் சலுகைகளை எதிர்பார்க்கும் சமரசவாதிகளும் தென் மாவட்டங்களுக்கு செல்ல வேண்டும். சாதி கொடுமையென்றால் என்ன என்பதையும் அதற்கெதிரான மக்களின் எழுச்சியையும் அவர்களின் அன்றாட வாழ்வில் அவர்கள் எதிர்கொளும் போராட்டங்களையும் காண வேண்டும்.

ஆனால் ஆண்ட பர‌ம்பரையினருக்கு எதிராக தாங்களும் ஆண்ட பர‌ம்பரையினரே என்று தாழ்த்தப்பட்டவர்களில் சிலர் கூறுகிறார்கள். இவர்கள் இவ்வாறு கூறுவது ஆண்ட பர‌ம்பரையினர் என்னும் குலப்பெருமையில் வாழ ஆசை படுவதையே காட்டுகிறது. ஆனால் தாழ்த்தபட்டவர்கள் ஒருகாலத்தில் வரலாற்றில் ஆண்டபறம்பரையினராய் இருந்திருந்தாலும் அவர்கள் ஆண்ட பரம்பர‌ையாய் வாழ்ந்ததற்கு ஒரு அடிமை சமூகமும் இருந்திருக்கும். இன்று இவர்கள் எவ்வாறு அடிமை தீயால் வேகின்றனரோ இதே அடிமை தீ அன்று அந்த அடிமைகளையும் சுட்டிருக்கும். ஆண்ட பர‌ம்பரையினர் எனும் ஆதிக்க சாதியினர் தேவர் என்றால் நாங்கள் தேவேந்திரர் என்றும், தாழ்த்தபட்ட மக்களுடன் எங்களை சேர்க்க வேண்டாம் என்றும், நாங்கள் தாழ்த்தபட்ட மக்கள் அல்ல என்றும் என்று சிலர் கூறுவது சற்று வேதனையான உண்மை.
நினைவிடத்தில் மக்கள் எழுச்சியை பார்த்துகொண்டிருந்த நேரத்தில் ஒரு துண்டு பிரசுரம் கைக்கு கிடைத்தது. இதில் சில கருத்துகள் மக்களை ஏய்க்கும் ஆட்சியாளர்களை விரட்டி அடிப்பது பற்றி இருந்தாலும் கீழ்காணும் கருத்துக்கள் நெருடலை உண்டாக்குபவையே.

தேவேந்திரகுலப் பெருமக்களே!

1. தேவேந்திரகுல வேளாளர் என்ற பெயரிலேயே அரசியலாக்குவோம் தலித்திய வியாபாரிகளிடமிருந்து விலகி நிற்போம்!
2. சமூக உரிமைப் போராளி இம்மானுவேல் தேவேந்திரர் என்ற பெயரிலேயே தலைவரை அடையாளப்படுத்துவோம்!
3. தேவேந்திரர்களை ஏமாற்றும் இந்திய, திராவிட மாயையிலிருந்து
விடுபட்டு, தமிழ் தேசியம் குறித்துப் பார்வையைச் செலுத்துவோம்

இவர்கள் தங்களை ஒடுக்கபட்டவர்கள் அல்லது தாழ்த்தபட்டவர்கள் என்று கூறிக்கொள்வதற்கே கூச்சப்படுகிறார்கள். அதனாலேயே தவறுதலாக கூட தாழ்த்தபட்டவர்கள் அல்லது ஒடுக்கபட்டவர்கள் சாயம் தன் மீது பூசப்பட்டுவிடக்கூடாது என்று கவனமாய் ‘தேவேந்திரர்’ என்றே தங்களை ஒவ்வொரு முறையும் அடையாளப்படுத்திக்கொள்கின்றனர். இதில் ஆதிக்க சாதியினரின் மனோபாவமே இவர்களிடமும் தெரிகிறது.

மேலும் ஒடுக்கபட்ட மக்களிடையே பள்ளர், பறையர், அருந்ததியர் என்னும் பிரிவை தாழ்த்தபட்ட மக்களின் தலைவர்களே வலிமைப்படுத்துகின்றனர்.

பார்ப்பனியத்தால் தன் அடையாளம் பறிக்கப்பட்டு ஊருக்கு ஒதுக்கு புறமாய் சேரியில் வாழும் தாழ்த்தபட்ட மக்களை பார்ப்பனியத்திற்கெதிரான போருக்கு அணி திரட்ட வேண்டிய கடமையுள்ள தலைவர்களே பார்ப்பனியத்தின் படிநிலையை சார்ந்து நின்று அதன் முகவர்களாக இருக்கிறார்கள். பள்ளர் சமூகத்தை சேர்ந்த தலைவர் பறையர் சமூகத்தை சேர்ந்த தலைவரை தன் தலைவர் என்று ஏற்றுக்கொள்வதில்லை. பறையர் சமூகத்தை சேர்ந்த தலைவர்கள் அருந்ததிய சமூகத்தை சேர்ந்த தலைவரை ஒருபோதும் தன் தலைவர் என்று ஏற்றுக் கொள்வதில்லை. அவரவர், அவரவர் சமூகத்தின் தலைவராகவே தம்மை அடையாளபடுத்திக்கொள்கிறார்கள். இவர்கள் அனைவரும் ஓட்டு சீட்டு அரசியலில் ஆதாயம் தேடி நமது மக்களை அடகு வைக்கும் வேலையை கச்சிதமாக குழப்பமின்றி செய்து முடிப்பதற்கும் இந்த தனி அடையாளம் பயன்படுகிறது. இத்தலைவர்கள் தன் வர்க்க நோக்கத்திற்காகவும் அரசியல் அதிகாரத்திற்காகவும் தலித் மக்களின் பிரிவினையை மேலும் விசாலமாக்குகின்றனர்.

மற்ற அரசியல் தலைவர்கள் மேல்த்தட்டு மக்களையும், நடுத்தர மக்களையும், அடித்தட்டு மக்களையும் ஒரு சேர ஏய்க்கும் வேளையில், ஏற்கனவே கசக்கி பிழியபட்ட அடித்தட்டு மக்களின் தலையில் மேலும் மேலும் மிளகாய் அரைக்கும் வேலையை தான் தாழ்த்தப்பட்ட மக்களின் தலைவர் என்று மார்த்தட்டிக்கொள்கிறவர்களும்,மீசையை முறுக்குகிறவர்களும் இன்று செய்து வருகிறார்கள். உழைக்கும் வர்க்கமாய் எழ வேண்டிய மக்களை தன் உட்சாதிய பிரிவின் பெரும்பாண்மையை கொண்டு எழ விடாமல் அவர்களை அழுந்தி, வர்க்க பார்வை கிடைக்கா வண்ணம் வெற்று வாய் சவடால்களின் மூலம் மக்களின் உள்ளக் கிளர்ச்சியை, போராட்டக் குணத்தை வேறொரு பக்கத்திற்கு மடைமாற்றி கொண்டு சென்று வரப்புக்கிழைத்த நீராய் அவர்களின் உணர்வுகளை வடித்து விடுகின்றனர்.சில நேரங்களில் தனது ரெளடி அரசியலுக்காகவும் கட்டபஞ்சாயத்துக்காவும் பயன்படுத்திக் கொள்கின்றனர். பெரும்பாண்மை இளைஞர்களை பிழைப்புவாதிகளாகவும் மாற்றியிருக்கிறார்கள்.

தியாகி இம்மானுவேலை படுகொலை செய்தவர்களின் பிறந்தநாள் அன்று அரசு விடுமுறை நாள் என்று அறிவிக்க வேண்டும் என்று அரசிடம் கோரிக்கை வைத்தது ஆதிக்க சாதி தலைவர்கள் அல்ல. இதே தாழ்த்தபட்ட மக்களின் பிரதிநிதி என்று சொல்லிகொள்ளும் ‘நிதி’ பிரியர்களே! இவர்கள் என்றும் மக்களுக்கு நேர்மையாய் இருக்கபோவதுமில்லை.தமது மக்களின் விடுதலையை தமது பிளக்ஸ் பேனர்களில் தவிர உண்மை வாழ்வில் முன்னெடுக்கப் போவதுமில்லை.

பிரமாண்டமாய் “இங்கே புரட்சியாளர் விதைக்கப்பட்டுள்ளார்” என்ற வாசகத்தை பின் சுவராக பெற்ற தியாகி இம்மானுவேலின் நினைவிடைத்தை அடையும் மக்கள், நினைவிடத்தில் மலர் வளையம் வைத்தும் தமது பால் குடங்களை வைத்தும், தம் வாழ்நிலை திணித்திய கருத்தியலில் அஞ்சலி செலுத்துகின்றனர்.

சாதி என்கிற வகையில் பார்ப்பனிய சாதி அமைப்பின் ஒடுக்குமுறைகளும், வர்க்கம் என்கிற வகையில் ஆளும் அதிகாரவர்க்கத்தின் சுரண்டலும் இரண்டற கலந்து ஒரு சேர தன் வாழ் நாள் முழுதும் வெள்ளபெருக்கு போல் தலித் மக்களை அடித்துகொண்டே இருக்கிறது.அவைகளுக்கு எதிராக தாழ்த்தப்பட்ட மக்கள் எதிர் நீச்சல் போட்டு கொண்டே வாழ வேண்டியுள்ளது. சுரணடலுக்கு உள்ளாகும் இம்மக்கள் வர்க்க உணர்வோடு எழ வேண்டிய சமயத்தில் பருண்மையாய் சாதி ஒடுக்குமுறை எனும் கொடுமைகளையும் எதிர்க்கவேண்டியுள்ளது.

ஒடுக்கப்பட்ட தேசிய இனமான “கருப்பின மக்களின் போராட்டம் என்பது வர்க்க போராட்டமே” என்று மாவோ கூறினார். நிலபிரபுத்துவ சமூகத்தில் ஆதிக்கம் செலுத்தியிருந்த நிலபிரபுக்களின் வாரிசுகள் சாதியின் பெயரால் இன்று கோலோச்சுவதை எதிர்த்தும் அடிமைகளாய் இருந்தவ்ர்களை இன்றும் தாழ்ந்த சாதி என்னும் பெயருடன் தன்னை அடிமை படுத்துவதை எதிர்த்தும் ஆளும் வர்க்கத்திற்கெதிராக தாழ்த்தபட்ட மக்கள் போராடும் போராட்டமே இது. தாழ்த்தபட்ட மக்களின் போராட்டம் என்பதும் வர்க்க போராட்டமே.ஆனால் இதை ஆளும் வர்க்கமும்,அவ்வர்க்கத்தை சேர்ந்த பலரும் சாதிப்பிரச்சனை என்று சுருக்கி அம்மக்களின் போராட்டங்களை அங்கீகரிக்க மறுப்பதுடன் ஆளும் வர்க்கத்தின் அதிகார மையதுடன் இணைத்து அற்ப சலுகைகளை அளிப்பதன் மூலம் இம்மக்களின் போராட்டங்களை மழுங்கடிக்கும் வேலையையும் செய்கின்றனர்.தலித் தலைவர்களும் தம் மக்களை ஆளும் கும்பலிடம் அடகு வைக்கிற‌ அரசியலை தான் ‘வீரதீரமாக’ செய்து கொண்டிருக்கிறார்கள்.

உலகில் எங்கும் இல்லாத சாதி எனும் சிறப்பு அம்சத்தை கொண்ட இந்த‌ நாட்டில் சாதிகொடுமைக்குள்ளாகும் மக்களிடமுள்ள‌ ஆதிக்க சாதிக்கெதிரான போராட்ட உணர்வை ஏகாதிபத்தியத்தை எதிர்க்கும் வர்க்க உணர்வோடு இணைத்து போராட்டங்களை முன்னெடுக்க வேண்டும்.தலித் மக்களை வர்க்க ரீதியாக அணிதிரட்டாமல் சாதியை எதிர்த்த போராட்டங்களை முன்னெடுக்க இயலாது.அதே போல ஆதிக்க சாதியிலுள்ள ஜனநாயக சக்திகளை தமது சொந்த சாதி்க்கு எதிராகவும் தலித் மக்களுக்கு ஆதரவாகவும் திருப்பாமல் சாதிய ஒடுக்குமுறைகளுக்கெதிரான போராட்டத்தையும் முன்னெடுக்க இயலாது.

ஒடுக்கப்படும் தலித் மக்களையும்,ஒடுக்கும் சாதியை சேர்ந்த உழைக்கும் மக்களையும், ஜனநாயக சக்திகளையும் பார்ப்பனியத்திற்கெதிரான போராட்டத்திலும் ஏகாதிபத்தியத்திற்கெதிரான போராட்டத்திலும் அணிதிரட்டி ஒன்றிணைக்காமல் பார்ப்பனீயத்தையும் வீழ்த்த முடியாது ஏகாதிபத்தியத்தையும் வீழ்த்த முடியாது.

சாதிய சமூகத்தை அடித்து தகர்ப்பதற்கு இது ஒன்றே வழி, இதற்கு மாற்றாக முன் வைக்கப்படும் ஏகாதிபத்திய தத்துவங்களாக ‘தலித்தியம்’ ஒட்டுப்பொறுக்கி அரசியல், மைய்ய நீரோட்டத்தில் பங்கு பெறுவது, அதிகார மைய்யங்களில் பங்கேற்க வைப்பது, இடஒதுக்கீடு போன்ற‌ சில்ல‌ரை சலுகைகள் அனைத்தும் ‘பார்ப்பனீய‌ சாதிய சமூகத்தை’ என்றைக்குமே ஒழிக்காது மாறாக அதை அதே நிலையில் அப்படியே தக்க வைக்கவே பயன்படும்.

தாராபுரம், ஜூன் 16: ஆதிதிராவிடர் பட்டியலில் இருந்து தேவேந்திரகுல வேளாளர்களை நீக்க வேண்டும் என்று வலியுறுத்தப்பட்டுள்ளது. தமிழ்நாடு தேவேந்திர குல வேளாளர் கூட்டமைப்பு மற்றும் தேவேந்திரகுல இளைஞர் பேரவையின் திருப்பூர் மாவட்ட செயல்வீரர்கள் கூட்டம் தாராபுரத்தில் அண்மையில் நடைபெற்றது. நிறுவனத் தலைவர் சி.பசுபதிபாண்டியன் தலைமை வகித்தார். மாவட்டத் தலைவராக எஸ்.முருகேஷ், செயலராக ஆர்.ஹரிதாஸ், துணைத் தலைவராக இ.ரமேஷ், துணைச் செயலராக எஸ்.கருப்புசாமி, பொருளாளராக அர்ஜூனன், இளைஞரணி அமைப்பாளராக ப.ரங்கநாதன் ஆகியோர் தேர்வு செய்யப்பட்டனர். தேவேந்திரகுல வேளாளர்களை ஆதிதிராவிடர் பட்டியலில் இருந்து நீக்கி, தேவேந்திரகுல வேளாளர் என்று தனி ஜாதிச்சான்றிதழ் வழங்குதல், தாராபுரத்தில் தேவேந்திரர்களுக்குச் சொந்தமான மயானத்தில் உள்ள ஆக்கிரமிப்புகளை அகற்றுதல், தாராபுரம் அரசு மருத்துவமனைக்கு போதிய டாக்டர்களை நியமித்தல், மருத்துவமனையைச் சீரமைத்தல் உள்ளிட்ட கோரிக்கைகளை வலியுறுத்தி தீர்மானங்கள் நிறைவேற்றப்பட்டன.

தேவேந்திரகுல வேளாளர் இன மக்களை,தனி இனமாக அரசு அறிவிக்கவேண்டும். அதனை வலியூறுத்தி சென்னை கோட்டையை நோக்கி அக்டோபர் மாதம் 9ம் தேதி, பேரணி நடத்தப் போவதாக‌, மள்ளர் இலக்கிய கழகத்தின் நிறுவனர் சுப.அண்ணாமலை தெரிவித்துள்ளார்.

தூத்துக்குடியில் இன்று நிருபர்களிடம் அவர் தெரிவிக்கையில், மள்ளர் இலக்கிய கழகம், மள்ளர்நாடு என்ற சமூக அமைப்பாக செயல்பட்டு வருகிறது. தேவேந்திரகுல வேளாளர் இனம் குடும்பன், காலாடி, பண்ணாடி, பள்ளன், கடையன், மள்ளர்,தேவேந்திரகுலத்தான் என,பல்வேறு பிரிவுகளாக அழைக்கப்பட்டு வருகிறது.

இந்த மக்களை தேவேந்திரகுல வேளாளர் இனமாக அரசு அறிவிக்கவேண்டும் என, மள்ளர் இலக்கிய கழகம் சார்பில் ஆர்ப்பாட்டங்கள் நடத்தப்பட்டு வருகிறது. மேலும், தென் மாவட்டங்களில்,மாவட்ட தலைநகர், தாலுகா தலைநகரங்களில் ஆர்ப்பாட்டம் நடத்தவும் முடிவு செய்யப்பட்டுள்ளது.

இதனை வலியுறுத்தி வரும் அக்டோபர் மாதம் 9ம் தேதி கோட்டையை நோக்கி பேரணி நடைபெறுகிறது. 19ம் நூற்றாண்டில் தான் பல்வேறு சாதிகளாக தேவேந்திரகுல இனமக்கள் அறிமுகப்படுத்தியுள்ளனர். இதற்கான,வரலாற்றுச் சான்றுகள் எங்களிடம் உள்ளது. தற்போது, எங்களை பட்டியல் இனமாகத் தான் அழைக்கவேண்டும். ஆனால், அரசு ஆதிதிராவிடர்களாக அறிவித்துள்ளது.

இதனை கண்டித்து கோர்டில் வழக்குகள் தொடுத்துள்ளோம். அதுபோல், திமுக ஆட்சி அமைத்த 3 வருடங்களில் 52 தேவேந்திரகுல இனத்தினர் படுகொலை செய்யப்பட்டுள்ளனர். அதிகார வர்க்கத்தினால் கொலை செய்யப்பட்டு வரும் எங்கள் இன மக்களுக்கு அரசு சமூக பாதுகாப்பு வழங்க வேண்டும். சரியான தலைவர் இல்லாததால் தான் எங்கள் இன மக்கள் பிரிந்து கிடக்கின்றனர்.இவ்வாறு சுப.அண்ணாமலை தெரிவித்தார்.

அவருடன், மாநில செய்தி தொடர்பாளர் ரத்தினமாணிக்கம், ஓருங்கிணைப்பாளர்கள் நல்லுச்சாமி, சோலைபழனிவேல்ராஜன், மாவட்ட பொறுப்பாளர் முத்துக்குமார், ஓன்றிய பொறுப்பாளர்கள் ஸ்ரீவைகுண்டம் சதிஷ்குமார், ஓட்டப்பிடாரம் கருப்பசாமி, விளாத்திகுளம் சுந்தரவேல்,தூத்துக்குடி சங்கர், முத்துமுருகன் மற்றும் பலர் உடனிருந்தனர்.

2009…. September 11th- It is our duty to pay our respects and honor to Sri. Emanuvel Sekara Devenderar who was killed by the criminals belong to one community in South Tamil Nadu.

All of you to march towards Paramakudi tomorrow…..

We expect about 5.5. Laks Devenderar to pay their rituals to the Thiyagi Emanuvel Devenderar.

Decorum will pay its salutes by about 11:30 am at his grave yard.

Decorum people from Sholavandan, Samayanallore, Nilakottai, Partibanoor, Alanganallore, Batalagundu, Theni, Selayampatti and Cumbam will join with the Decorum EC members.

DECORUM E.C. & Administrative Council paid its tributes and respects to our Devenderar Emanuvel Sekaran at Paramakudi to day morning. Many Devenderar are on the way to pay their respect to the Brave Devenderar Thiyagi.

Nearly 6 laks people to turned up to salute this Late Hero.

All parties are trying to project their image by attending this big function.

People from Thirumavalavan party, Vijakanth Party, AIDMK, BSP, Congress and Krishnasamy party are actively moving to fall in line and march towards Paramakudi.( all parties are trying to convince and prove that they are powerful in side the community and powerful to others outside.)

Many Devenderars are doing Anna Thanam from their road side stalls.

Devenderar Panbattu Kazagam Paramakudi has arranged food for all at the Devenderar Kalyana Mandabam itself.

Heavy police security arrangements.

People in the city were not tensed, and moving around normally.

All the shops are open except TASMAK.

புதிய தமிழகம் கட்சி கொடியை தடை செய்யக்கோரி தொடரப்பட்ட வழக்கை சென்னை ‌‌நீ‌திம‌ன்ற‌ம் தள்ளி வைத்துள்ளது.

தமிழ்நாடு தேவேந்திரகுல வேளாளர் கூட்டமைப்பு தலைவர் பசுபதி பாண்டியன்,சென்னை சிட்டி சிவில் ‌நீ‌திம‌ன்ற‌த்‌தில் மனு ஒன்றை தாக்கல் செய்தார்.

அந்த மனுவில், பல தலைமுறைகளாக எங்கள் வகுப்பைச் சேர்ந்தவர்கள் மேலே சிவப்பு நிறத்தையும், கீழே பச்சை நிறத்தையும் கொண்ட 3:2 அளவில் கொண்ட கொடியை பயன்படுத்தி வருகிறோம்.இந்த கொடி எங்களுக்கே உரித்தானது.

ஆனால் இந்தக் கொடியை புதிய தமிழகம் கட்சி பயன்படுத்தி வருகிறது.ஆகவே புதிய தமிழகம் கட்சி இந்த கொடியை பயன்படுத்துவதற்கு தடை விதிக்க வேண்டும்'' எ‌ன்று மனுவில் கூறியிருந்தார்.

இந்த மனு சென்னை 5-வது சிட்டி சிவில் ‌நீ‌திம‌ன்ற‌த்‌தி‌ல் நீதிபதி முகமதுஅப்தாகிர் முன்பு விசாரணைக்கு வந்தது.அ‌ப்போது புதிய தமிழகம் கட்சி தலைவர் டா‌க்ட‌ர் கிருஷ்ணசாமி சார்பில் வழ‌க்க‌றிஞ‌ர் பிரபாகரன் ஆஜராகி வாதாடினார்.

''புதிய தமிழகம் பயன்படுத்தி வரும் கொடிக்கு தடை விதித்தால் சட்டம் ஒழுங்கு பாதிக்கும்.1995ம் ஆண்டு முதல் இந்த கொடியை புதிய தமிழகம் பயன்படுத்தி வருகிறது.புதிய தமிழகம் தேர்தல் ஆணைய‌த்தா‌ல் அங்கீகரிக்கப்பட்ட கட்சியாகும்.

சட்டமன்றம், பாராளுமன்றம் உள்பட 6 தேர்தல்களில் இந்த கட்சி போட்டியிட்டுள்ளது.புதிய தமிழகம் பயன்படுத்தி வரும் கட்சி கொடியானது தேவேந்திரகுல வேளாளர் கூட்டமைப்புக்கு சொந்தமானது என்பதற்கு எந்தவிதமான ஆதாரமும் கிடையாது. ஆகவே எக்காரணத்தை முன்னிட்டும் தடை விதிக்க கூடாது'' எ‌ன்று வழ‌க்க‌றிஞ‌ர் ‌பிரபாகர‌ன் வாதாடினா‌ர்.

இதை‌த் தொட‌ர்‌‌ந்து கொடிக்கு தடை விதிக்க மறு‌த்த நீதிபதி, வழக்கை வரும் ஜூன் 1 ‌ம் தேதிக்கு தள்ளிவைத்தார்.

MELBOURNE: After violent attacks and expose of migration scams, the woes of Indian students in Australia seem to be mounting with new scandal breaking that a large number of overseas students had copied their masters thesis particularly in the IT programme.

The fresh scam exposed by 'The Australian' newspaper said several overseas students, including Indians, were found to have graduated from University of New England with copied masters thesis which gave them better chance of getting permanent residency.

The paper said some of the students were allowed to graduate even after a probe began into the scam. The scandal was more prevalent for a master programme in the Information Technology offered by the New South Wales University.

This has been an attractive course for students hoping for permanent residency as skilled migrants, the paper said.

According to the report, most of the students were from the Indian subcontinent but their characteristic English was interspersed with polished American and British English.

When contacted, a university spokesman said that most of the students were from Pakistan, Bangladesh and India.

The degree, begun with a commercial partner in 2004, turned out 220 plagiarised thesis of the 230 that were checked. To date, no UNE staff member responsible for the programme has been publicly held to account. The course was taught by the Melbourne Institute of Technology - UNE's partner.

Material for one thesis had been lifted from 'The Guardian' newspaper in Britain and a US business magazine. Several other thesis were also found similar, the report said.

It said the whistle-blower, mathematician Imre Bokor, claimed that the official count was that 220 of 230 thesis were plagiarised.

"When I first let them know, there were fewer than 100 thesis involved. By the time they investigated, it had grown to 230," he said, adding that a visiting Polish academic alerted him in July 2006 to the abysmal standard of one of the first thesis to emerge from the programme, begun in 2004.

"I realised, just by reading the first page, it was obviously plagiarised," he said.

Bokor said he had already approached his two immediate superiors with concerns about poor standards in the programme and the risk of plagiarism. "They just pooh-poohed me and told me to go away," he said.

The report said that education commentators praised UNE vice-chancellor Alan Pettigrew for resolute action when he went public about the scandal in August 2007.

He said UNE would not "shy away from taking the most difficult steps" and might strip students of their degrees.

Bokor claimed plagiarism had been first raised in November 2006 and in just one case. But he said UNE had quickly established that "a significant proportion" of 210 thesis appeared to be plagiarised.

An email about SUN corporation of Tamil Nadu

As you may have heard/known, SUN corporation of Tamil Nadu(owns SUN TV, SUN pictures, Kalignar TV etc) is owned and operated by the TN chief minister Karunanithi (and his family). This SUN TV never telecast any of the pictures/videos (of the victims/bombing etc) nor did say much while the war on Tamils was going on. Not only that, they even went further criticizing the Tamil Nadu Eelam activists for their part in this. I don't have to elaborate on Karunanithi' s role on the Vanni Massacre. Now the only weapon we, the diaspora Tamils have is our wealth. SUN pictures are producing the movie "Enthiran" now. It is the highest budgeted movie ever produced in India(?). They are expecting to release this in over 30 countries and hoping that the Eelam Tamil diaspora will pour millions in to their coffers.

We cannot allow this to happen. SUN corporation was silent when atrocities on Tamils were being staged. Not even a single line on their daily news telecast about the SL governments attacks on Tamils. They even telecasted SL army pictures and videos on fleeing Tamils and SL government's version of the war. We have to show our strength in 'boycotting' SUN pictures and SUN TV. This is a great opportunity for us. Will the young Tamils take a lead in this campaign to send a message to Karunanithi and his goons?

VAVUNIYA, Sri Lanka (CNN) -- After visiting a displacement camp in Sri Lanka on Saturday and flying over the site of the last battle in the country's recently ended civil war, U.N. Secretary-General Ban Ki-moon called the sites "appalling."

"I have traveled around the world and visited similar places, but this is by far the most appalling scenes I have seen," Ban told CNN. "I sympathize fully with all of the displaced persons."

Ban called for better humanitarian aid after interviewing some of the people regarding shortages of water and medicine.

Ban toured Manik Farm, a sprawling camp for internally displaced people in the country's north, days after Sri Lanka declared victory in a 25-year civil war against the Tamil Tigers rebels.

About 250,000 to 300,000 people are refugees in the country, according to humanitarian groups and U.N. figures. Some in the camp have experienced fierce fighting in recent months, saying they did not believe at points that they were going to survive.

"I have seen the complete devastation here, and there must have been in the crossfire many civilian casualties. There simply must have been," Ban told CNN's Sara Sidner.

The Sri Lankan government has said it doesn't believe many civilians were injured or killed in the fighting.

While the war's end elicited celebrations in some parts of the country, humanitarian groups and the United Nations worry over those uprooted by the fighting. Ban arrived in the South Asian island nation Friday, saying he came to offer help and partnership.

"I hope my visit today can help begin a process of national recovery, renewal and reconciliation for all Sri Lankans," Ban said in a written statement issued Friday. "That is why I am here."

Ban met with Sri Lankan President Mahinda Rajapaksa and asked that humanitarian organizations be given unrestricted access to provide more aid to the displaced. The president seemed open to the idea, Ban said.
Ban said earlier he would urge the government to expedite the screening and processing of refugees and ensure that displaced camps have adequate supplies of food, medicine and water.

இலங்கையில் யுத்தப் பிரதேசத்தில் சிக்குண்டுள்ள தமது உறவினர்களைத் தொடர்புகொள்வதில் புலம்பெயர்வாழ் தமிழர்கள் எதிர்கொள்ளும் சிரமங்களை விளக்கும் பெட்டகம்.

விடுதலைப் புலிகளின் பகுதிகளில் தொலைபேசி வசதிகளை அரசு பல மாதமாக துண்டித்து விட்டது. போர் உக்கிரமடைந்ததுவிட்டதன் காரணமாக புலிகளின் அனுசரணையுடன் நடத்தப்படும் செய்மதி தொலைபேசி வழியாக வன்னியில் இருப்பவர்கள் தமது உறவினர்களை தொடர்பு கொள்வதும் குறைந்துவிட்டது.

மற்றொறு புறம் வவூனியா முகாம்களில் இருப்பவர்களை எப்படி தொடர்பு கொள்வது என்பது தெரியாத நிலையும் உள்ளது.

LOS ANGELES – Larry Manchester first saw the body on Feb. 18, 1976.

The woman, a 67-year-old retired school administrator, was dead inside her red-and-black '65 Chevy Chevelle, two blocks from her west Los Angeles apartment.

The young homicide detective popped open the trunk and saw Elizabeth McKeown lying on her side. She was naked from the chest down. She'd been beaten, raped and strangled three days earlier.

Despite his efforts and a $25,000 reward, Manchester and his colleagues could not solve the killing. For 33 years and long after he retired, Manchester, now 64, berated himself. He would clip newspaper stories about similar murders in hopes of spotting a clue.

On Thursday, the Los Angeles Police Department announced it had solved McKeown's case. The suspect, they said, was likely responsible for the murders of as many as 30 women, dating to the mid-1950s, which would make him the most prolific killer in city history.

"I was crying," Manchester said of his reaction when he learned John Floyd Thomas Jr., 72, had been arrested. "It was remarkable that they caught him."

Thomas, an insurance claims adjuster, is charged with two killings after cold-case detectives matched his DNA to the McKeown murder and to the 1972 strangling of Ethel Sokoloff, 68, who was sexually assaulted.

The LAPD said it also has partial DNA matches to two other killings, and he is a suspect in three killings in Inglewood. The Los Angeles County Sheriff's Department is looking at him in at least two other cases.

"We believe that Thomas is likely connected to many more sexually motivated murders," Deputy Chief Charlie Beck said.

Thomas, who was being held on $1 million bond, could not be reached for comment. The public defender's office said he had yet to be assigned an attorney.

Because the killings occurred before the 1977 reinstatement of the death penalty, prosecutors are seeking life in prison without parole. If Thomas is charged in later cases, they may seek death.

In Los Angeles in the mid-1970s, a man police dubbed "The Westside Rapist" entered the homes of elderly women who lived alone, raped them and choked them until they passed out or died. Beck said police believe Thomas is the rapist and may be involved in scores of unsolved rapes.

The attacks stopped in 1978 — the year Thomas went to prison for the rape of a Pasadena woman.

He may also be involved in killings beyond Los Angeles. A decade later and 40 miles to the east, at least one elderly women in Claremont was found raped and killed. The Los Angeles Times reported Thomas was being investigated for the death of five elderly women in that city, but sheriff's spokesman Steve Whitmore said only one case was being looked at there.

The victims in all 30 cases under review were older white women, mostly of lower incomes and often widows living alone. All were sexually assaulted and most were strangled.

Police said Thomas, who is black, likely targeted the women because of their vulnerability and because they all lived alone. Cold-case detective Richard Bengston said serial killers frequently select victims of a different ethnicity.

Thomas had been twice convicted of sexual assault, and as a registered sex offender, he was required to check in annually with police.

During one visit in October, officers took a saliva swab to collect his DNA, which is a requirement for all sex offenders. Police weren't sure why he had not given a sample sooner.

Police Chief William Bratton and other officials credited Proposition 69, a voter-approved initiative that requires convicted felons and certain arrestees to submit DNA samples that are stored in a statewide database.

DNA and fingerprinting are the most important tools at a cold-case detective's disposal, Bengston said. When the killings were first investigated, there was no central computer system to quickly flag possible connections between crimes, and detectives relied on teletypewriter printouts and monthly meetings to exchange information.

Thomas was arrested at his South Los Angeles apartment on March 31, authorities said. Soon after, he resigned from his job with the State Compensation Insurance Fund in Glendale.

Born in Los Angeles, Thomas was 12 when his mother died. He was raised by an aunt and godmother and joined the Air Force in 1956. He was considered sloppy and late and was dishonorably discharged, according to the Times, which first reported the story.

In 1957, he was convicted of burglary and attempted rape in Los Angeles and sentenced to six years in prison. After his release, parole violations sent him back behind bars until 1966.

The allegations about Thomas stunned a friend, Earl Ofari Hutchinson, prominent host of the Los Angeles Urban Policy Roundtable and a commentator and author of books on the black experience in America.

"Shocked, shocked, shocked," said Hutchinson, who had known Thomas since about 1989. "He was very engaging, very involved, seemed very informed."

He said Thomas is married and has children.

Los Angeles police are still investigating at least a dozen other murders connected to an unidentified serial killer who has been dubbed the "Grim Sleeper."

LONDON: The number of Indians jailed in Britain has risen by 35 per cent since September 2005 with about 350 presently serving their terms in various prisons across the country, Ministry of Justice has said.

Indian prisoners in British jails numbered 350 in September this year, compared with 259 in September 2005, the ministry informed MPs in a written reply.

The number of foreign national prisoners has increased to 11,168 by September this year - an increase of 11 per cent - from 10,265 foreign nationals in February 2006. The number of Pakistani nationals was 406.

Vietnam and Poland alone account for more than half of this increase. The number of prisoners from Vietnam has risen by 286 per cent, to 460 prisoners while the number from Poland by 192 per cent, to 452 prisoners.

This increase is despite introduction of the Facilitated Returns Scheme and the extension of the Early Removal Scheme by September 2008.

In 2007, 7,400 foreign prisoners were released from jails in England and Wales, including those who were deported later.

The Conservative party said that despite Prime Minister Gordon Brown's repeated pledge that foreign nationals who commit crimes in Britain "will be deported" and "will pay the price", thousands of foreign national prisoners were not only being freed, but were actually being released early, having served less than half of their sentence.

Criticising the Labour government for its handling of the issue, Shadow Justice Secretary, Nick Herbert, said: "The Government want to create the impression that they were successfully deporting foreign national criminals, but the truth is that for every three prisoners they remove, two more are released onto the streets."

KUALA LUMPUR: An Indian national has been convicted and sentenced for eight years for forcing a compatriot into prostitution after promising her a job as maid in Malaysian capital. R Punitha, herself a prostitute, pleaded guilty before Judge Mohammed Nasir Mordin. She screamed, cried and hit her head when the sentence was announced, the official Malaysian news agency Bernama reported. She was charged for exploiting S Maruthambal, 33, through force and threats at a house. According to the facts of the case, Maruthambal came under Punitha's care after she was sweet-talked by agents in India that she could get a job as a maid in Malaysia. During her confinement, Maruthambal was forced to provide sexual services to 20 to 25 men daily and her earnings were taken by Punitha. She was also threatened by Punitha that if she refused, her family in India would be killed by gangsters there. Maruthambal managed to escape to the Indian High Commission before making a police report, The Star newspaper said.

Xmas celebration not dampened by church attacks

Christians across Karnataka, where around 15 churches were vandalised in September over alleged conversion and insult to Hindu gods, celebrated Christmas with fervour.

Hundreds thronged brightly-lit churches for the midnight mass in Bangalore. There were large crowds also in the coastal city of Mangalore and central Karnataka town of Davangere, the two places where several churches had been attacked.

Police personnel guarded the churches.

Archbishop Bernard Moras led the mass at St. Xavier's church in Bangalore and wished people of Karnataka peace, harmony and friendship.

LONDON: An Indian-origin man, who was jailed for five years for human trafficking in April this year, has been asked to pay more than 3,00,000 pounds by a UK court.

The Leicester Crown court ordered Asif Patel, one of the six people convicted in January this year of smuggling illegal migrants from India into Britain, to pay the amount by January 31 next year, or face a further five years in prison.

Patel (32) owned a mobile phone shop in Bolton, and was jailed on April 21. At the confiscation hearing, Judge William Everade ordered him to pay back 3, 03,368 pounds.

The court was told that Patel sent money to contacts in India who recruited the clients, using a money exchange bureau. Each of the illegal migrants smuggled into the UK reportedly paid around 8,000 pounds.

Besides Asif Patel, other members of the people smuggling gang were Sajid Bhikhi, Asif Bhikhi, Sikandar Patel, Soyab Patel and Sabbir Patel. They were sentenced to different terms of imprisonment.

The people smugglers forged or stole documents to bring Indian citizens illegally into Britain via South Africa, often on forged South African passports. Holders of the passports can enter Britain as visitors for a period of six months.

The investigation, which began in September 1999 after an illegal passport-making factory was discovered under a staircase in a house in Leicester, was led by Britain's Serious Organised Crime Agency (SOCA) and spanned several countries.

In some cases, after the Indian nationals were brought into Britain, they were then facilitated to travel to Canada or the US through the collusion of a corrupt official at the Heathrow airport in UK.

Further action against Indian trafficker

LEICESTER: A Leicester court is to begin hearing on whether the assets of an India-born shopkeeper, who was jailed for human trafficking early this year, be confiscated or not.

Asif Patel, from Daubhill in Bolton, England, was part of a gang that used forged passports to bring thousands of Indian nationals into Britain. His home was raided in 2006 as part of a police investigation into illegal immigration.

Patel, aged 32, who owned a mobile phone shop, was jailed for five years on Apr 21 this year after he was found guilty.

The Leicester Crown Court heard his role including handling large payments from clients, who paid 8,000 pounds for their passage into Britain.

The Bolton News has reported that a week-long confiscation hearing is due to begin at Leicester Crown Court Monday to investigate into Patel's assets.

WASHINGTON: Sonal Shah, the Indian-origin member of US president-elect Barack Obama's transition team, whose links with VHP sparked criticism, has renounced her affiliation with the Hindu outfit accused of fomenting violence against Muslims and Christians in India.

Shah, former member of the Vishwa Hindu Parishad, has said if she could have anticipated the outfit's role in the 2002 communal violence in Gujarat, she would have never associated with its US branch, a year before the incident.

"Had I been able to foresee the role of the VHP in India in these heinous events, or anticipate that the VHP of America could possibly stand by silently in the face of its Indian counterpart's complicity in the events of Gujarat in 2002 -- thereby undermining the American group's cultural and humanitarian efforts with which I was involved -- I would not have associated with the VHP of America," Shah said.

In a statement, obtained and posted by NextGov and the National Journal, the Google executive said the 2002 Gujarat carnage was one of the "most profound tragedies" in the long history of the state when "extremist political leaders, including some associated with the VHP, incited riots that resulted in the deaths of thousands."

In an e-mail sent to her supporters, Shah asked for help in combating the allegations and expressed apprehension that the Obama transition team could ask her to resign.

"I need your help," wrote Shah. "This is gaining legs as the National Journal also picked it up and likely Fox. I need to mobilise people against the leftists and the right wing. There is a likely chance that they will ask me to resign as team does not need my publicity."

Shah has formerly been with the Goldman Sachs and served as a Treasury Department official in the Clinton administration.

He added that the document describes the motivational context, catalogues crimes, and constructs legal arguments establishing culpability of a U.S. citizen and a U.S. greencard holder for the crime of genocide against Tamils in Sri Lanka under the U.S. Genocide Accountability Act (18 U.S.C. 1091).

Sarath Fonseka and Gotabhaya Rajapaksa were selected as defendants in lieu of SL President Rajapaksa because Gotabhaya is a U.S. citizen and Fonseka, a permanent resident alien, for whom the United States is responsible as moral, political, and legal matter, Bruce Fein explains.

TamilNet: Can you describe the legal process your group has chosen to bring Sarath Fonseka and Gotabhaya Rajapaksa to justice in U.S. courts?

Fein: The United States Genocide Accountability Act of 2007 (GAA) makes Fonseka and Gotabhaya Rajapaksa subject to a genocide prosecution in United States courts even though the genocidal acts against Tamils occurred in Sri Lanka.

The United States may constitutionally assert extra-territorial jurisdiction over a certain category of universally condemned crimes, which include genocide and torture. The United States recently brought a torture prosecution against the son of Liberia’s Charles Taylor for torture perpetrated in Liberia. They are criminally culpable under the doctrine of command responsibility for criminal acts of their subordinates which they should have known about and prevented or neglected to punish after-the-fact.

TAG [Tamils Against Genocide] has virtually completed a model federal grand jury indictment of Fonseka and Rajapaksa charging violations of the GAA. The facts demonstrating genocide have been compiled from TAG’s independent research and investigations. The two were selected as defendants in lieu of President Mahinda Rajapaksa because Gotabhaya Rajapakse is a U.S. citizen and Sarath Fonseka is a permanent resident alien for whom the United States is responsible as moral, political, and legal matter.

The model indictment will be presented to the new United States Attorney General appointed by President Obama and the new Secretary of State. The two appointees hold the keys to a genocide prosecution, which only the government can initiate.

NEW DELHI (Reuters) - Former Indian Prime Minister V.P. Singh, remembered for his controversial policy of reserving a larger share of jobs for the country's disadvantaged castes, died on Thursday after a long battle with cancer.

Singh, 77, who was suffering from blood cancer and chronic renal failure, died on Thursday afternoon in New Delhi's Apollo hospital, a hospital spokesman said.

Prime Minister Manmohan Singh, no relation to the deceased, said India had lost a great patriot whose empathy for the country's poorer classes would always be remembered.

Singh served as finance and defence minister in late Prime Minister Rajiv Gandhi's cabinet but parted ways with Gandhi, and led a coalition that defeated him at the 1989 elections.

He is best known for his policy of reserving government jobs for India's disadvantaged castes, which sparked off widespread protests from the country's upper classes.

Singh's move, aimed at empowering India's oppressed poorer castes, fragmented the country's politics and led to the emergence of strong caste-based parties.

When Sonal Shah was appointed to US President-elect Barack Obama's transition team shortly after his historic election victory, there were initially loud cheers from many sections of US society.

For Americans invested in minority representation, the presence of the Indian-born American woman on the first black US president's team was further proof that the times had changed.

For the fast-growing Asian Indian community in the US, Shah's rise was testament to the strides the community had taken.

More than 7,000 miles away, in Indian living rooms, Shah's presence on a team that could help design the future of the world somehow brought the prevailing Obamamania closer home.

But within days, Shah was dogged by a controversy that roiled the Indian-American community, sparked a media debate back in India and now threatens to cast a pall over a sizeable number of progressive voters who backed Obama. As the new US President-elect prepares for his Jan. 20, 2009 inauguration, it puts the spotlight on the complex business of governance that Obama now has to face after a groundswell of support delivered him the top spot in the White House.

And it also brings to the fore the issue of India's increasingly international Hindu extremist groups, a phenomenon largely overlooked by the international community.

At the heart of the latest fracas are Shah's contested links with a hard-line Hindu organisation that international rights groups, as well as the US State Department, have implicated in deadly anti-Muslim and anti-Christian violence in India.

Born in India, but raised in the US, where her parents moved when she was a toddler, Shah's credentials are impeccable. The head of Google's Global Development Initiatives, Shah's past posts include vice president of Goldman Sachs. As an economist, she has also served in the US Treasury Department and the National Security Council.

But it's in her do-gooder role as co-founder of Indicorps, a Texas-based NGO that encourages Indians abroad to participate in development work back home in India, that Shah has sparked the latest spat.


An anti-Shah salvo is fired

The first salvo was fired by Vijay Prashad, director of International Studies at Trinity College, Connecticut, who charged that Shah was an active member of the VHPA.

The VHPA (Vishwa Hindu Parishad of America) is the US branch of the VHP (Vishwa Hindu Parishad or World Hindu Council), a Hindu extremist group accused of involvement in the 2002 anti-Muslim riots in the western Indian state of Gujarat in which more than 850 people were brutally killed.

The VHP ideology views India as a Hindu state and regards the country’s multi-religious diversity as a result of historic "foreign invasions" by Muslims as well as Christian missionaries and colonisers.

In recent months, the VHP has been implicated in the deadly anti-Christian violence in the eastern Indian state of Orissa which claimed about 60 lives, destroyed more than 4,000 houses and left as many as 50,000 Christians homeless.

While the VHP's virulent Islamophobia has been largely overlooked by a US administration consumed by its "war on terror", the organisation's anti-Christian campaign has been officially noted and condemned by the US State Department.

The VHP is part of a network of extremist Hindu groups – including the Bajrang Dal and the RSS (Rashtriya Swayamsevak Sangh) – that has ties to the BJP, India’s main opposition party. Together, these organisations, along with a host of others, form the sangh parivar (or "family" of Hindu nationalist groups).

In an article published in a US biweekly, Prashad raised Shah's involvement in relief and charity operations by the VHPA - which play an important role in the organisation's global outreach – to question Shah's suitability in Obama's transition team.


‘Factually inaccurate internet rumours’

Within days, the Indian media as well as the blogosphere erupted in a tidal wave of acrimonious debate.

Reacting to the charges, Shah issued a statement denouncing the "factually inaccurate internet rumours" linking her to "Hindu nationalist groups." She stressed that her "personal politics have nothing in common with the views espoused by the Vishwa Hindu Parishad, the Rashtriya Swayamsevak Sangh, or any such organisation."

FRANCE 24 tried to contact Shah as well as representatives of the Obama transition team, but neither responded.

For its part, the VHPA mirrored Shah's written statement. "All I will say is Sonal Shah is not associated with the VHPA. She has not been in any office in any capacity with the organisation," said VHPA spokesman Shyam Tiwari in a phone interview with FRANCE 24. In a statement subsequently emailed to FRANCE 24, he reiterated that "Sonal is not associated with the VHP of America in any capacity whatsoever."

But a 2001 VHPA press release appears to undercut Tiwari's claims.

The release, issued shortly after the Jan. 2001 Gujarat earthquake, lists VHPA relief efforts – including wiring $50,000 for "immediate rescue and relief efforts" - and lists Sonal Shah as a "National Coordinator" for the relief effort, above Tiwari's contact information.

When confronted with this evidence by the press, Tiwari subsequently said, "Sonal was a member of the VHP of America at the time of the earthquake. Her membership has expired."

She's not 'an insular child of American suburbia'

The controversy has put the spotlight on the shadowy route of international funds pouring into sangh parivar coffers from a network of charity and relief organisations. Gujarat, the state from where Shah's parents hail, is often at the heart of the international money trail since the western Indian state has an extensive diaspora, with more than a million people of Gujarati origins living in the US and the UK alone.

Following the VHP money trail in Gujarat though is particularly difficult since funds – often in cash - are frequently transferred within the extended business family structure.

In her statement denying links to the VHPA, Shah states, "I'm proud to have helped coordinate relief work following the Gujarat earthquake of 2001, or cultural and religious affiliations of some of my family members, or apolitical humanitarian work I've been privileged to do as a founder of the NGO Indicorps and as the director of global development for Google.org."

But in a phone interview with FRANCE 24, Prasad said Shah's statement denouncing the politics of division and religious hatred was "gratifying, but unpersuasive." He added that he found her denial was irresolute. "It's okay to say she doesn't share the philosophy of the group,' he said. "But she didn't take the opportunity to question, if not condemn, the role these groups played in the violence in Gujarat."

Shah's supporters though note that even if there were tenuous links between the Indicorps co-founder and the VHPA, Shah herself was merely aiding relief efforts during a natural disaster. "It would be deeply wrong if participation in collecting earthquake relief… would be considered enough to disqualify her for office," reads a letter of support by a handful of prominent Indians printed in “Outlook”, a New Delhi-based weekly.

Indeed the blogosphere is awash with Shah's defenders, ranging from Hindu right wing sympathisers to secular progressives. While the latter admit that Shah probably made an "error of judgment," they note that as an Indian American, she may not have been aware of the VHP's nefarious nature.

It's an argument that cuts little ground with Naresh Fernandes, editor-in-chief of TimeOut India, who has extensively covered communal violence in India. "A woman as smart as Shah would have to have blocked out all media reports for her not to know what the VHP represents in India," he said. "Besides, she also runs an NGO in India so it isn't as if she's some insular child of American suburbia."


In the Modi mode

Another troubling issue is Shah's failure to denounce Gujarat Chief Minister Narendra Modi, a controversial Hindu right wing politician who was denied a US diplomatic visa in 2005.

Modi’s existing tourist/business US visa was also revoked under a US rule that makes any foreign government official who "was responsible for or directly carried out, at any time, particularly severe violations of religious freedom" ineligible for a visa to the United States.

Prashad notes that despite Modi's well documented complicity in the horrific 2002 Gujarat riots, Shah accepted a 2004 Gujarat state award, which her brother accepted on her behalf in Modi's presence.

Shortly after Obama's victory, the Indian press was speculating about whether the new US administration would finally grant Modi a US visa.

Shah's defenders note that her Modi links are hazy and she can hardly be faulted for an innocuous award acceptance for her commendable relief work in Gujarat.

Prashad however rejects the argument. "It's like if someone received an award from [former Serbian President] Slobodan Milosevic and said 'I just did charity work for victims of the war,'" said Prashad.

The Milosevic analogy is guaranteed to spark another furious roar in a bitter blogosphere battle that shows no sign of dying and is a warning for the new US president-elect as he prepares to take over the White House come Jan. 20, 2009.

New York(IANS): Coalition Against Genocide, a group of Indian American individuals and organisations fighting against religious fundamentalism, has in an open letter urged Sonal Shah, a member of president-elect Barack Obama's transition team, to come clean on her alleged past affiliations with right wing Hindu outfits.

The Coalition Against Genocide, in their letter that was released to the press Thursday, said her recent statement in which she repudiated espousing the cause of organisations like the Rashtriya Swayamsevak Sangh (RSS) and Vishwa Hindu Parishad (VHP), does not allay all of their concerns.

However, it welcomed her recent public statement where Shah said her "personal politics have nothing in common with the views espoused by the Vishwa Hindu Parishad, the Rashtriya Swayamsevak Sangh, or any such organisation".

Shah had issued this statement early this month after the coalition raised questions on her selection in Obama's transition team by arguing that she had undeniable links with organisations like RSS and VHP.

But this is not enough, given the irrefutable public record of her family's linkages to the VHP and other Sangh Parivar organisations, said the Coalition, which a few years ago had successfully launched a campaign against issuing a US visa to Gujarat Chief Minister Narendra Modi.

"Your family's connections with the Sangh Parivar have been long, deep, well documented, and presumably continue to this day. So we must respectfully reject any parallels drawn between attempts during the campaign to find president-elect Obama guilty by association and legitimate questions about your past affiliations," the letter said.

The Coalition urged Shah to come clean by publicly urging the Indian government and state governments of Orissa and Gujarat to speedily bring to justice and rehabilitate the thousands of alleged victims of the Sangh Parivar's anti-minority violence and to take immediate and effective measures to prevent such violence in future.

"These steps will lend much credence to your statement that you do not subscribe to the views of Hindu nationalist groups," the letter said, reminding Shah of the high standard of openness and personal accountability set by Obama during his campaign and now as president-elect.

"In that spirit, we hope that you too will take personal responsibility for your undeniable past links with the Sangh Parivar and reconcile your recent statement against the VHP and the RSS with your silence amidst the most egregious human rights violations by them in Gujarat and elsewhere," the letter said.

"We further hope that you will unequivocally disown and repudiate your and your family's past and current associations with the VHP and all other Sangh Parivar organisations," said the Coalition.

The letter has been endorsed by over a dozen Indian American organisations and over two dozen individuals. The letter said they represent families who have grievously suffered from the alleged anti-Muslim and ant-Christian programmes of the VHP.

Indian-American groups protest Sonal Shah's appointment

NEW YORK: Three Indian-American groups have protested the appointment of Sonal Shah in US President-elect Barack Obama's transition team, claiming that she is closely associated with the VHP and warned against Hindutva "infiltration" into the power centres of the US society.

In a joint statement, Indian Coalition Against Genocide and Indian American Coalition for Pluralism and Non Resident Indians for a Secular and Harmonious India said they are holding consultations among themselves and like-minded Indian-American leaders on the issue.

The organisations have asked Shah to clarify her position about her association with the VHP and its "mother organisation" RSS.

The statement said they have avowed to increase their efforts to "educate the American politicians and business leaders about the attempts by the Hindu ultra-nationalist Hindutva movement to infiltrate the power centres of the US society by giving big donations and through volunteer work."

The Coalition Against Genocide was instrumental in getting the visa of Gujarat Chief Minister Narendra Modi revoked in 2005, it recalled and voiced concerns that an attempt might be made to get his visa reinstated.


After India media reports linked Shah to the Vishwa Hindu Parishad, her brother Anand Shah had said the 40-year economist's family had nothing to do with the VHP or the Gujarat government.

Shah was on November 6 named in a 15-member team which will oversee smooth transition of power from the Bush Administration to the incoming Obama dispensation.

Houston, PTI : The Obama-Biden transition team has roped in a number of Indian-Americans, mostly specialists and leading academicians, to assist the Democrats in assuming the responsibilities of the administration.

The appointees are no strangers to the first ever African-American President-elect Barack Obama, with most of them having longstanding association with him.While Indian American Nick Rathod has been appointed director to the Office of Inter-governmental Affairs, Parag Mehta from Texas will oversee affairs of minority groups, including Asian Americans and Pacific Islanders, as deputy director of inter-governmental affairs and public liaison.Rathod is currently national outreach director of South Asians for Obama and one of its founding members. Arti Rai, an ex-classmate of Obama at the Harvard Law School, currently a professor of patent law at the Duke University, has been appointed member of the agency review team on science, technology, space, arts and humanities.

Many Nations Have Failed to Stem Mental, Physical, Sexual Abuse

Governments need to punish abusive employers through the justice system, and to prevent violence by reforming labor and immigration policies that leave these workers at their employer’s mercy.

(New York, November 24, 2008) - Many migrant and domestic workers still face abuse and exploitation in Middle Eastern and Asian countries because governments have failed to adopt measures needed to protect them, Human Rights Watch said today ahead of the International Day for the Elimination of Violence against Women on November 25.

Few domestic workers have access to the justice system in the countries where they work, and even those who are able to make complaints of physical or sexual violence rarely receive redress, Human Rights Watch said.

"There are countless cases of employers threatening, humiliating, beating, raping, and sometimes killing domestic workers," said Nisha Varia, deputy director of the women's rights division of Human Rights Watch. "Governments need to punish abusive employers through the justice system, and prevent violence by reforming labor and immigration policies that leave these workers at their employers' mercy."

Millions of women from countries including Indonesia, Sri Lanka, the Philippines, and Nepal are domestic workers in Saudi Arabia, Kuwait, the United Arab Emirates, Lebanon, Singapore, Malaysia, and other countries throughout the Middle East and Asia. Most countries exclude domestic workers from protection under their labor laws, leaving domestic workers little remedy against exploitative work conditions.

Domestic workers are also at heightened risk of abuse because of restrictive immigration-sponsorship policies that link their visas to their employers. Employers control a worker's immigration status and ability to change jobs, and sometimes whether the worker can return home. Many employers exploit this power to confine domestic workers to the house, withhold pay, and commit other abuses.

Authorities receive thousands of complaints of labor exploitation or abuse each year. While most involve unpaid wages, food deprivation, and long working hours with no rest, a significant number allege verbal, physical, and sexual abuse. But many cases are never officially reported, due to domestic workers' confinement in private homes, lack of information about their rights, and employers' ability to deport them before they can seek help.

Some law enforcement authorities have begun to prosecute and punish abusive employers, although to varying degrees. In 2008 in Singapore, several employers have been convicted of beating domestic workers, receiving sentences ranging from three weeks to 16 years in prison. In mid-November, a man was sentenced in Malaysia to 32 years in prison for raping a domestic worker, and his wife received six years for abetting the crime.

But criminal justice systems often continue to expose abused domestic workers to further victimization and give them no - or only severely delayed - redress:

  • In May 2008, a Riyadh court dropped charges against a Saudi employer who abused Nour Miyati, an Indonesian domestic worker, ignoring both the employer's confession and compelling physical evidence. Nour Miyati suffered daily beatings and was abused so badly that her toes and fingers were amputated after developing gangrene. During the three years of legal proceedings, she remained stuck in an overcrowded embassy shelter unable to work or return to her family in Indonesia. At one point, she also was sentenced 79 lashes for changing her testimony, though the sentence was later reversed.
  • On November 27, 2008, a Malaysian judge is to announce the verdict in the four-year case against Yim Pek Ha, the employer of an Indonesian domestic worker, Nirmala Bonat. In 2004, images of Bonat's badly burned and injured body shocked Malaysians. Bonat also had to stay in an overcrowded embassy shelter for years without being allowed to work and had to defend herself from charges of inflicting the abuse herself.

"2008 marked a year of missed opportunities,'' Varia said. "While most governments have started to think about some level of reform, many of these discussions have stalled. Providing comprehensive support services to victims of violence, prosecuting abusers, and providing civil remedies are reforms that just can't wait."

Human Rights Watch recommends that, in order to curtail all forms of violence against migrant domestic workers, governments should:

  • Abolish or reform immigration-sponsorship policies so that domestic workers' visas are no longer tied to their employers;
  • Develop protocols and train law enforcement officials on how to respond to domestic workers' complaints appropriately, and how to investigate and collect evidence in such cases;
  • Prosecute perpetrators of psychological, physical, and sexual violence;
  • Expedite criminal cases involving migrant domestic workers, who must often wait for a resolution for several months or years while confined in a shelter, and ensure they have legal permission to work during the interim period;
  • Create and widely disseminate contacts for confidential, fully staffed and toll-free hotlines to receive reports of abuses against domestic workers;
  • Create comprehensive referral and support services, including health care, counseling, shelter, consular services, and legal aid.

Sri Lanka: Human Rights Situation Deteriorating in the East

Armed Faction Is Killing, Kidnapping Civilians

(New York, November 24, 2008) – The Sri Lankan government should take immediate steps to address the deteriorating human rights situation in the country’s Eastern Province, where there has been an increase in killings and abductions in recent weeks, Human Rights Watch said today.

Many abuses in the Eastern Province appear to have been carried out by armed elements of the Tamil Makkal Vidulthalai Pulikal (TMVP). The TMVP was originally the political wing of the armed faction earlier known as the Karuna group. It enjoys the strong backing of the government of President Mahinda Rajapakse. Karuna broke away from the rebel Liberation Tigers of Tamil Eelam (LTTE) in 2004.

“The Sri Lankan government says that the ‘liberated’ East is an example of democracy in action and a model for areas recaptured from the LTTE,” said Brad Adams, Asia director at Human Rights Watch. “But killings and abductions are rife, and there is total impunity for horrific abuses.”

Human Rights Watch investigations have found that there have been at least 30 extrajudicial killings in the Eastern Province since September. In one recent case, the bodies of two young Tamil men who had been detained by the police on October 3, 2008, during a security roundup in the town of Batticaloa were found on a beach six days later with their hands and legs tied to a concrete pole, and showing signs of severe torture.

The police claimed that the men, Kandasamy Kugathas, 18, and A. Gunaseelan, 26, were released on the morning of October 4. But a family member of one of the men saw them at the police station that evening. A Human Rights Watch investigation found that the two were taken from their cells at about midnight by men in civilian clothing who had demanded the two by name. Since the killings, the police have intimidated witnesses into changing their account of the killings and falsified important evidence.

On November 2, unidentified gunmen shot and killed five Tamil youth at Kalmunai beach in Ampara district. On October 20, three Sinhalese contractors working in Kokakaddichchoalai in Batticaloa district were shot dead. On October 16, four farmers, two of them Tamils and two Muslims, were shot dead near their land. The killings were in a restricted area near a Tamil Makkal base, accessible only with a police pass. In Trincomalee on September 21, Sivakururaja Kurukkal, chief priest of the Koneswaram Temple, was shot dead in broad daylight while riding his motorcycle in a high-security area near several government checkpoints.

In addition to the recent killings, Human Rights Watch has learned from credible sources of at least 30 abductions in Akkairappatu and Adalachennai divisions in Ampara district in September and October. Witnesses said the abductions were carried out by armed men in civilian clothes who spoke Tamil, suggesting they belonged to the TMVP or other paramilitary groups.

In a case investigated by Human Rights Watch in Ampara in October, a young man previously detained, beaten, and released by the group was reported missing soon after his release. As in a number of other cases, family members did not report the case to the authorities out of fear that harm would come to the victim.

Members of civil society organizations and journalists in the East have also been threatened and attacked. On October 29, Sankarapillai Shantha Kumar, a member of the NGO Consortium in Akkaraipattu, was abducted around midnight from his home. Although a complaint was filed, there has been no credible investigation and he is still missing.

On September 8, Radhika Thevakumar, a journalist with Thinakaran, who at the time was working for the Pillayan faction of the TMVP, was shot and severely wounded in Batticaloa. On September 10, K. Kunarasa, provincial correspondent for the Thinakaran Tamil-language daily in Ampara, received death threats that caused him to limit his reporting. These and other threats and attacks against journalists have caused the media to curtail reporting on the security situation in the East.

“Many in the East believe that the government has given its blessing for these abuses,” said Adams. “It is important for the government to take action against perpetrators to demonstrate that this is not the case.”

Reports of these killings and other abuses come at a time of deepening tensions and violent infighting within the TMVP, particularly between factions loyal to Karuna Amman, the founder, and Sivanesathurai Chandrakanthan, known as Pillayan, who was appointed the chief minister of Eastern Province in May.

Karuna returned to Sri Lanka in July, after serving a six-month sentence for immigration fraud in the United Kingdom, and has reclaimed the leadership of the group. On October 7, the government appointed Karuna to Parliament. Both men have been implicated in serious human rights abuses, both while with the LTTE and after they left. The abuses included abducting large numbers of children and forcing them to serve as soldiers.

A clash between the two TMVP factions on October 28 in Chenkalady, in Batticaloa, resulted in the death of four members, including a 16-year-old who had been forcibly recruited by the group. Five others were reported missing after the incident, including another boy. On November 14, the president of the TMVP party and Pillayan’s private secretary, Kumaraswamy Nandagopan, known as Ragu, and his driver were shot dead in the capital, Colombo.

Human Rights Watch has recently documented several cases of forcible recruitment of children by the TMVP. There have been three recent escapes from the group’s Valachennai site in Batticaloa – a 15-year-old who had been held since April on October 31; a 15-year-old who was taken in 2006 from Kiran on November 3; and a 17-year-old held since October 2006 on November 10. Escapees often must go into hiding to prevent being abducted again. In some instances, their families have faced pressure to give a “replacement” child soldier to the group.

“Far from being a reformed and responsible party ready for government, the TMVP is still actively involved in serious human rights abuses,” said Adams. “Instead of holding the group accountable, the Rajapakse government has provided unqualified support. The government needs to open independent investigations into all serious human rights violations and hold perpetrators accountable.”

New Delhi, November 24: : Aspiring to form a Government at the Centre, Uttar Pradesh Chief Minister and BSP supreme Mayawati reached out to Muslims and upper castes in Delhi by promising to provide reservation for poor among them if voted to power.

Addressing her second rally in the capital where BSP has fielded candidates in all the 70 seats, she also said her party was committed to extend the quota regime to financially weaker sections of the upper castes as she sought to dispel the notion that BSP represented the interests of only backward castes.

"We will provide reservation to poor Muslims if voted to power," she told a public meeting in Aligaon in south Delhi.

"We are also in favour of providing reservation to the financially poor sections of the upper castes," said Mayawati, who returned to power last year in UP by successfully experimenting with a social engineering formula.

Accusing both the Congress and BJP of being "pro-rich," the Dalit icon said, these parties had always catered to the interests of industrialists and businessmen, on whose support they have thrived.

"BSP, on the other hand, does not depend on this class and has a mass support base," she said vowing to replicate the formula of all-inclusive growth adopted by her party in UP.

"We intend to bring to Delhi our policies of financial and social reform that we have followed in Uttar Pradesh," she said.

From 1951 onwards, reservation for the Backward Classes was 25 per cent but the Sattanathan Commission recommended a separate educational and employment reservation of 16 per cent for the Most Backward Classes and 17 per cent for the Backward Classes.

In 1969, the Dravida Munnetra Kazagham government under M Karunanidhi appointed the first Tamil Nadu State Backward Classes Commission with A N Sattanathan as the chairman. The Commission found that the Most Backward Classes -- or MBCs -- in Tamil Nadu had a very small presence in state services and professional colleges as they were clubbed together with other castes.

In 1971, the DMK government hiked the reservation for the Backward Classes from 25 per cent to 31 per cent and for the Scheduled Castes and Scheduled Tribes from 16 per cent to 18 per cent.

In 1980, much before the V P Singh government's Mandal move, the Tamil Nadu government had implemented 69 per cent reservation for backward classes in educational institutions and jobs.

In 1980, MGR's All India Anna Dravida Munnetra Kazagham government increased the reservation for the Backward Classes from 31 per cent to 50 per cent...From then on, there has been 69 per cent reservation in educational institutions

The second Tamil Nadu State Backward Classes Commission came into existence on March 15, 1993, at the Supreme Court's instance. It was formed to examine and recommend upon the requests relating to inclusion and exclusion from the list of Backward Classes and Most Backward Classes.

The Commission conducts enquiries on the representations received from various community organisations and individuals for inclusion of their communities in the list of Backward Classes.

The Commission looks into three factors while identifying a caste group as backward -- social backwardness, economic backwardness and educational backwardness. The weight-age allotted is 50 per cent for social backwardness, 40 per cent for educational backwardness and 10 per cent for economic backwardness

Professor Radhakrishnan disagrees. He says there is no connection between reservation and admissions, particularly in the context of Tamil Nadu, because almost every group is included in the 69 per cent category, except a few upper castes.

"At least 90 per cent of the population is included in the reservation net. If you look at the data of the last five years, you will see that it is only the creamy layer of the Other Backward Classes that gets all the benefits," says Professor Radhakrishnan

"If you look at the employment data, the SCs and the STs have not benefited. For the last 56 years, reservation has not reached the needy, and there is data to show that," he insists.

At least 35 per cent of India's population the age group between 20 and 25 aspires for higher education, but the present enrolment in higher education -- beyond the higher secondary level -- is only 9 per cent to11 per cent, as against 45 per cent to 85 per cent in developed countries.

CBI to reopen investigations into Nanded blasts

MUMBAI: With fresh leads emerging out of Malegaon blast case, the CBI may soon reopen investigations into the 2006 Nanded blast, which is being seen as a main indicator of saffron group emerging as a major terror network.

While officially the CBI had adopted a taciturn policy on the issue, sources in the agency said it would reopen the case as some leads had emerged during the investigations into the September 29 Malegaon blast in which 11 people, including Lt Col Shrikant Purohit, have been arrested.

CBI's role had come into question from the probe conducted by central security agencies and Maharashtra's ATS, the agency appeared to have not taken due cognisance of deposition of one of the accused arrested in the case.

The accused, whose voice had to be restored after operating his vocal chord which was damaged in the blast, had told investigators that Naresh Rajkondwar, a Bajrang Dal activist, had allegedly planned three blasts outside mosques that shook Jalna and Parbani in Maharashtra in 2003 and 2004.

Several rounds of meetings took place between the CBI officials and central security agencies where sleuths probing the Malegaon blasts pointed out some of the alleged loopholes in the investigations carried out by the CBI.

The Nanded bomb blast took place in the intervening night of April 4 and 5, 2006 at the residence of Laxman Rajkondwar, allegedly a RSS worker. Rajkondwar's son Naresh and Himanshu Panse, who was VHP activist, were killed while assembling the bomb.

CBI had chargesheeted ten people in the case. But sources said it has not been able to trace back the leads provided by some of the accused who claimed to have admitted, before investigators, their role in the earlier blasts.

Recoveries made from Rajkondwar's house included Muslim skull caps, fake beards and a plan showing that the target was to hit a mosque at Aurangabad, nearly 200 km from Nanded.

The CBI would now be focussing more on recovery of over a ton of explosives used in manufacturing of fire crackers and its links with the previous blasts.

Sources said that one of the accused had told the investigators that he was sent to Pune by Naresh on his train ticket on the day when crude explosive material was thrown outside a mosque in Jalna in 2004, a move aimed at creating an alibi for Naresh and to show that he was not in town when the blast took place.

The CBI was also asked by central security agencies as to why the call details of Naresh were not investigated properly, the sources said and claimed that one such call had been traced to an important functionary of a saffron outfit in Ayodhya.

The CBI would also try and probe the links of 10 arrests in the Malegaon blast case including Lt Colonel Srikant Purohit, with the Nanded case.

The agency had investigated the Nanded blast and filed a chargesheet on March 15, 2008 against 10 people which included Sanjay Chowdhury, Yogesh Deshpande, Maruti Wagah, Gunniraj Thakur and Mahesh Pandey, allegedly associated with Bajrang Dal besides the two who were killed.

Indian techie pleads not guilty of Intel theft

NEW YORK: An Indian techie, indicted by a federal jury of theft of trade-secret data of Intel worth $1 billion and wire fraud, has pleaded not guilty.

Bishwamohan Pani, 33, was arraigned before a federal court in Boston on Thursday afternoon. Pani pleaded “not guilty” on all five counts, a court clerk said on Friday.

The next hearing in has been scheduled for Jan 13, 2009.

On November 6, a federal grand jury had indicted Pani of stealing trade secret information from Intel, where he worked till June, before joining its rival AMD. The indictment alleges that days before joining AMD, Pani remotely downloaded 13 “top-secret” Intel documents, along with other confidential information of the company.

These included a document which explained how encrypted documents could be reviewed when not connected to Intel’s computer system. It also included information about Intel’s processes for designing its newest generation of microprocessors.

Kerala woman waits for dead son's body from Gulf

PARAVUR: Not giving up hope, a 62-year-old woman here has been waiting for over three months to receive the body of her son, who died in Saudi Arabia in July this year after being allegedly beaten up by his Egyptian officer.

The woman, Vasumathi, had pinned all her hopes on her 32-year-old son, Subeesh, and had gathered whatever little she had to send him to the Gulf nation, hoping their misery would end.

But that was not to be. To her horror, she received information that her son had died after being beaten up by an employer. Since then she has been waiting to see her son for one last time.

Following the intervention of some good samaritans and a human rights organisation in Saudi Arabia, efforts are on to complete the post mortem of the body and bring it to Kerala as early as possible, Vijaykumar, Vice President of Federation of Malayali Association in Saudi Arabia, said.

Subeesh was working in a sand mining company at Alkarji, about 400 km away from Riyad. On July 14 this year, seeing his Egyptian superior beating up another Keralite, Subeesh tried to stop him when he was also beaten up.

Having suffered some internal injuries, his friends Vijaykumar and Balan, who were working in another company, admitted him to Sumarshia hospital where he died after 12 days on July 26.

His body has been kept at the hospital mortuary as 'unknown' body.

BSP hopes for a Maya wave in MP

““Ab koi ruk nehi payegi, Hati Dilli jayegi (None can now stop the elephant’s march to Delhi)”, bellowed another elderly BSP supporter Munnalal Kushwaha, waving the party’s blue flag with the picture of a jumbo (the party’s symbol) embossed on it.

Pandey is a Brahmin and Kushwaha a Dalit. Both were among the thousands who waited for the chief minister of the neighbouring state for nearly three hours at the Phool Bagh Maidan here.

“They call ours a party of Dalits. But, look at our government in UP. Many upper-caste people are now ministers,” said Mayawati. “We have also given tickets to many Brahmins, Kshatriayas and other upper-caste people in Madhya Pradesh too”, she added.

She has been on a whirlwind tour of the poll-bound state for the past few days — hoping that her now-famous formula of ‘social engineering’ that helped the BSP win votes of both the upper and lower castes in UP would do magic here too.

The BSP is contesting all seats, and many of its candidates are former Congress and BJP stalwarts, who quit their parent organisations after being denied tickets.

Balendu Shukla of the Congress is one of the big catches of the BSP in the Gwalior-Chambal region. The 63-year-old Brahmin leader is now the BSP candidate in the Gwalior South constituency. Nine of Mayawati’s candidates in the 34 constituencies in Gwalior-Chambal region are Brahmins, while six others are Kshatriyas.

The BSP chief on Saturday spoke about several development and welfare projects launched by her government in UP and promised to replicate them in MP if her party is voted to power. “Our party feels that there should be reservation for poor people belonging to upper castes too. And, I promise this will be our priority, once we reach the seat of power in Delhi,” said Mayawati.

Karnataka: Church blasts case hearing on Nov 28

The Special Court hearing cases on blasts in Churches in various parts of Karnataka in 2000 has adjourned the hearing to Nov 28.

This was after the judge S M Shivangoudar heard the arguments from both the sides. Several activists of Deendar Anjuman Organisation had been convicted in the case and quantum of punishment is yet to be pronounced.

Charges, including the one on waging war against the country have been framed against the accused. The charges attract capital punishment or life imprisonment.

Prosecution sought capital punishment as the act of the convicted amounts to waging war against country. Public prosecutor Nilogal had argued that the act of accused indicates their anti-social nature. They burgled the churches before planting bombs. The court should note that some of them were educated, engineers, doctors and BHEL employees.

The counsel for the accused had sought reduction in quantum of punishment considering the family background of the accused and the circumstances under which they resorted to such acts. Defence counsel G Jairaj claimed that the accused resorted to such acts to prevent religious conversion activities.

The bombs exploded when there was no one in the churches. The intention behind exploding the bombs was not to claim lives or cause damage to the buildings, he said. They resorted to such acts as they were emotionally
immature.

Dalit students have been facing various problems in education institutions including in reputed institutes like JNU, DU, TISS and AIMS. Recently there were student's death in Hyderabad Central University and Dalit girl students' death in Pondichery and Madras Universities and a Young girl's death in Engineering College in Kerala.There are many atrocities and discrimination against dalit students in cases in many colleges and universities. The Dalit students have been abused and harassed by caste Hindu teachers, students and goons as they (Dalits) face discrimination both inside and outside campuses. This is the situation throughout the country. The Dalit students suffer in almost in all colleges. The management always favors the Caste Hindu teachers and students and victimizes the Dalit students.

Case in Dr. Ambedkar Law College, Chennai

There was a series of problems for Dalit students in Dr. Ambedkar Law College, Chennai. Last four years especially since the establishment of Thevar Peravai(Thevar is the Caste Hindu leader for the community, which has the history of discriminating Dalits inaspect)the caste Hindu (Thevar) students have been abusing and attacking Dalit students in the college campus and hostels. This matter has been reported to police and both Mr. Karunanithi and Ms. Jayalalitha `s government was very aware of this incidence. The many of the Thever students have been asking to remove Dr. Ambedkar's name and rename the college as Chennai Law College . They always negatively comment and abuse Dr. Ambedkar in the presence of Dalit students. They also use derogatory words and caste names to abuse Dalits. Last four years many atrocity cases have been filed against Thevar students. Six month back a group of Thevar students planned to attack Dalit students and were caught by police.

But police did not take any action against them. Mr. Bharathi Kanna, student leader of Thevar Peravai is said to be an instrument for many of these incidence and three months back he was charged a case under SC/ST (POA) Act. FIR was filed but no interrogation happened after that and also he was instrumental for many problems.

The Thevar students organized a Guru puja (for Pasumpon Muthuramalingam, a Thevar leader) on October, 30 2008. They published a pamphlet in which they did not want to use Dr. Ambedkar's name, instead they just wrote " Chennai Law College ". Some of the Dalit students protested against this act and asked them to write full name of the college. These students were beaten by the Thevar students and were injured badly and hospitalized. These students were in critical condition. But there was no action against any students in this regard. The Dalit students were threatened to death. Many Dalit students could not go to examination out of fear as they experienced brutal attacks earlier by Thevers. On 12th Dalit students went to write examination and they were attacked by the Thevars with knife. Bharathi Kannan & Armugam attacked Chithiraiselvan, a third year dalit student of Dr Ambedkar Law College. They cut his ear and hit on his head which led him for life or death situation. This led some of the friends of the victim intervene to save Chithiraiselvan. Bahrahti Kannan was well protected and properly hospitalized in special ward at General Hospital , Chennai while Chithiraiselvan treated as an accused and denied proper emergency care and protection in Royapettah Government Hospital .

Chitraiselvan told the National Commission for Scheduled Caste on Saturday that he was the first to be attacked allegedly by students belonging to a backward community on that day. They were armed with deadly weapons, he told the commission. S.S. Sharma, Joint Director of the Commission told that Chitraiselvan who was inside the campus along with other Dalit students, when a group of backward class students attacked him causing injuries on his head and ear. Seeing blood oozing out of his ears, the Dalit students attacked the other group of students and later took Chitraiselvan to the hospital.

At this juncture we need to interrogate and find the truth regarding the incidents and make sure that the victims are ensured appropriate remedy and justice, and also to build need full mechanism to protect vulnerable Dalit students.

The incident of violence on 12.11.2008 at Dr.Ambedkar Law College has shaken the conscience of every body. This incident surely needs to be condemned. The reason behind the submission of details herein is to bring out the facts behind the incidents of violence at a law college that we all believe is to produce future judges and socially conscious lawyer.

That clashes take place in the law college is not a new phenomena. We are shaken thoroughly to know the details of the brewing tension over the past four years that has broken out violently today. "Thevar Peravai" that functions with its headquarters at Chennai has been concentrating, specifically targeting the Thevar community students from the southern districts of Tamilnadu. It functions primarily in whipping up the passions and utilizes them for their vested parochial goals. With these students a casteist organization named ' Mukkulothor Student's Federation" has already been formed. The main objective of this organization is to target and attack the Dalits. And they also raise queries like while all other 4 govt. law colleges are named as Govt.law college, why should the Chennai law college be named after Dr.Ambedkar and called Dr.Ambedkar law college. Since Dr.Ambedkar is a Dalit this name should be changed. This is their contention for their past 4 years. They do not use Ambedkar's name in any of their advertisement and mention it only as 'Chennai Law College'.

Such activities has raised unnecessary discomfiture amonsgtthe dalit students and raised a sense of hatred between the communities. In all these issues Bharathi Kannan, belonging to Mukkulathor Student Federation is the prime culprit. In the recent past,( in 6 months duration) Bharathi Kannan was waiting with five of his friends with swords in hand prowling to kill atleast tow Dalit boys. Police came to know of this and arrested him red handed with 3 long swords in their possession. But they were released without any complaints been filed against them. Though the college authorities were in the know of his activities it did not make any efforts to curb him. In the same manner he with his friends went and attacked the students of Dr.Ambedkar Law college residing in hostel at Millers road, Kilpauk. The Principal did not take any action. At least there are 17 cases including attempt to murder, pending on Bharathi Kannan.

In this circumstance on '30th October' during the Thevar Jayanthi the passion were whipped up. The poster prepared by Mukkulothor Students Federation expressed the re assertion of its casteist hierarchy, with usages avoiding Dr. Ambedkar's name. Also they teased the Dalit students on that day. The Dalits who questioned this were beaten up and with the law college students having exams from 3 rd of November, Mukkulothor Students Federation declared that any Dalit entering the college would be thrashed and killed. They were roaming around in the college complex with logs, iron rod, dagger and swords. Dalit boys could not enter the hall. Some Dalit boys came sneaking through and wrote the exams. Police or college authority did not take any action even though they were in the know of things.

Only on such a condition they came on 12.11.2008with logs, sticks etc for self protection. College authorities insisted that the students should avoid precipitating the issue. The Dalit students retorted stating that when the college authorities did not take any action when they were being prevented from attending exams, and they had come there for giving protection for Dalits and not attacking the Mukkulathor. Since some Dalit students have come for exams and Mukkulathors have identified and planned to attack them, they came for their defence. In such a situation Bharathikannan, Arumugam and Ayyadurai with daggers 2 ft. long, jumped in shouting that they shall kill at least 5 or so and moved towards the Dalit students. The Dalit students ran helter- shelter for their safety. When Bharathi Kannan and Arumugam ran and caught hold of Chithraiselvan, a Dalit student and tried to stab him down through the head. When he turned and saved his head his ears were torn off by the dagger. Other students joined in to save Chithrai Selvan and hit Bharathi kannan and Arumugam.

The sole responsibility for this callous approach rests entirely with the college authorities. For the last 4years when in the name of celebrating Thevar Jayanthi, efforts to assert caste hierarchy were being made, specifically failing to address Dr.Ambedkar Law college as such and naming it only as Chennai law college, threatening of the Dalit students, issuing threat to life for those Dalit students who opposed bringing caste conflict into the campus etc were brought to the notice of the college authorities no action was taken. Especially, for the last three days when it was brought to their notice of the magnitude and massive proportion of the brewing trouble, police or the college authorities made no action was taken to prevent the same.

In this situation Bharathi Kannan came in with daggers in hand to attack Dalit students. If the college authorities had acted in time this incident of violence could have been prevented.

Our demands:

1) Take appropriate action on the Principal for failing to take necessary action in time to prevent the brewing violence.

2) College authorities should initiate necessary action to prevent the casteist organizations that function from within the campus triggering violence.

3) Give due protection to all the students especially the Dalit students.

4) Take necessary action on those behind the incidents of violence, the organization, Thevar Peravai for fomenting casteist feelings.

5) Take appropriate action on the police authorities that failed to prevent the students who prowled inside the college campus for the past one week with weapons.

Law colleges across the State remained closed on 13/11/2008 in protest against the violence witnessed in Dr Ambedkar Law College here on Wednesday.

Television footage showed a group of students armed with iron rods and wooden staffs beating another group and the shocked public looking in disbelief on Wednesday evening. Later, police intervened after getting permission from the college principal.

Police said the root cause of the violence was the objection raised by Dalits to a poster put up by caste Hindus on October 30 to mark the birth anniversary of Muthuramalinga Thevar in which Dr Ambedkar¢s name was omitted in the reference to the college. Efforts by the police and college authorities to defuse tension failed and things came to a boil on Wednesday when Dalit students were ambushed as they were coming out after writing a semester examination.

The armed group lay in wait for students writing semester examinations and attacked them when they came out of the examination halls.

The police moved in and arrested seven students after the violence subsided. Additional Commissioner of Police (North Chennai) Abhay Kumar Singh told reporters on Thursday that more arrests would follow. He said one Assistant Commissioner of Police and an inspector attached to the police station in whose jurisdiction the incident took place, had been suspended and four sub-inspectors had been transferred.

In a retaliatory strike, a government bus was torched in the early hours of Thursday in north Chennai by activists of the Ambedkar People¢s Revolutionary Organisation.

The Government late on Thursday evening transferred Chennai Police Commissioner R Sekhar, Joint Commissioner( North) Abhay Kumar Singh and two deputy commissioners under whose jurisdiction the law college comes. Mr Sekhar was replaced as Commissioner of Police by ADGP( Civil Supplies) K Radhakrishnan. This was in addition to the suspension of an assistant commissioner of police and an inspector attached to Esplanade Police Station and transfer of four sub-inspectors announced earlier in the day. In another move, the Government appointed A K Viswanathan, Director of Vigilance and Anti-corruption as Additional Commissioner( Law and Order).

The violence in the Chennai college provoked protests by law students in Salem, Madurai, Coimbatore and Tirunelveli on Thursday. In Coimbatore, students ransacked the halls where semester examinations were going on. Window panes were broken in heavy stone-throwing and steel chairs and tables were smashed.

The government ordered a judicial inquiry by retired judge Shanmugham, besides ordering the closure of the Chennai college and placing its principal under suspension. These measures were announced by Law Minister Durai Murugan in the State Assembly.

Noisy scenes were witnessed when AIADMK whip D Jayakumar demanded that CM M Karunanidhi resign on moral grounds. Durai Murugan¢s disparaging comment against AIADMK general secretary J Jayalalitha led to loud protests from AIADMK members and they were evicted en masse on the orders of Speaker R Avudaiappan. Later, the members of the MDMK walked out in protest, too.

For the seventh year running, India is the leading source of foreign enrolments on US campuses, sending a record 94,563 students during the academic year 2007-2008.


WASHINGTON: A legendary Indian-American tech guru and a teenage Indian-American science prodigy won high recognition in the United States this week in yet more vindication of the ethnic group's growing reputation for producing science and technology ‘brainiacs’.

Amar Bose's induction into the National Inventors’ Hall of Fame came as no surprise considering his long-hailed contribution to acoustics technology.

This year, he joins inventors who gave the world the television remote control (Robert Adler), electrocardiograph (Willem Einthoven), hip replacement surgery (John Charnley), and Containerized Shipping (Malcolm McLean) in the national scroll.

The only other Indian in the Inventors’ Hall of Fame is Rangaswamy Srinivasan, a former IBM scientist named for his pioneering work on excimer laser surgery. The list has storied names like Thomas Edison and Wright Brothers.

Meanwhile, a teenage Indian-American student from North Carolina who began to take interest in cancer research when she was six won the prestigious Intel Science Talent Search (Watch) , annual competition often termed the "junior Nobel Prize".

Shivani Sud, 17, a Durham high school student, was awarded a $100,000 college scholarship during a ceremony in Washington on Tuesday for her research to improve colon cancer treatment.

Sud's interest in the subject began as a child when an immediate family member was diagnosed with a brain tumour. She would lug heavy books to her mother, a former cytogeneticist, and ask her to explain the science, according to accounts in the local News and Observer. In middle school, she began working in laboratories through programs at Temple University, Duke University and the National Institutes of Health.

Sud's most recent work focuses on early-stage colon cancer, an illness in which as many as 30 per cent of patients relapse after treatment.

By identifying a predictor that would determine which patients are likely to suffer relapses, she hopes to prevent patients who are unlikely to benefit from chemotherapy from going through the expensive and painful treatment.

Looking at genetic predictors may also help doctors choose the best medications for cancer patients.

Sud was among the seven high school students of Indian origin who made the list of 40 finalists in the annual Intel competition that attracted some 1600 high school seniors nationwide.

The others, who each get $ 5000 scholarship and a laptop, are Avanthi Raghavan of Florida, Shravani Mikkilineni of Michigan, Hamsa Sridhar and Ashok Chandran of New York, Isha Jain of Pennsylvania, and Vinay Ramasesh of Texas.

The recognitions came at a time when the Indian government boasted, on the basis of dubious, unsubstantiated numbers, that its education system was responsible for the large number of Indian scientists and engineers across the world.

Neither Bose, whose mother was German, nor Sud and the other students are products of the Indian system, although in the case of the latter, some experts have suggested that Indian parental attention to education may have had a role in their success.

CHANDIGARH: A Haryana Railway police team has reached Mumbai to interrogate Malegaon blast case suspects Lt Col Srikant Prasad Purohit and Sadhvi Pragya Singh Thakur after it was established that suitcase bombs, which blew up two bogies of Indo-Pak Samjhauta Express train in February last year were assembled in Indore. "Our team has gone to Mumbai yesterday. Today, they could not interrogate anyone as other agencies investigating the Malegaon case are also busy with them," Inspector General (Railway Police), K K Mishra said on Thursday.

He said they had already informed Mumbai's Anti terror Squad that they wanted to question Purohit and Pragya.

"Earlier, our investigations in the Samjhauta probe had led us to Indore after we got clues that the suitcases and stichings on them which were used in the explosions were procured from Indore," he said.

Sixty eight people were killed in the explosions on Samjhauta Express that runs between Delhi and Lahore.

Both Purohit and Pragya Singh have been arrested from Madhya Pradesh in connection with Malegaon blast and are in custody of Maharashtra ATS.

ATS tightlipped on Purohit's laptop

The Maharashtra ATS probing the Malegaon blast case remained tighlipped on whether a laptop of arrested army officer Prasad Purohit believed to be containing crucial information had been traced.

ATS officials said they would not comment on the issue as the laptop was a crucial part of the investigation.

The information in the laptop is expected to throw further light on the conspiracy behind the blast that took place in the communally-sensitive town of Maharashtra on September 29 killing six persons, officials had said.

The laptop is said to contain names of 54 persons who are suspected to have undergone training in handling of arms and explosives at Bhonsala Military School in 2001.

Officials at the Kalina Forensic Science Laboratory in the suburban Santacaruz denied reports that they had received a computer for analysis.

Purohit, a serving army officer, is among the 10 persons arrested for their alleged involvement in the Malegaon blast in which six were killed and about 80 injured.

Four persons including Sadhvi Pragya Singh Thakur, retired army official Ramesh Upadhyay, Abhinav Bharat member Sameer Kulkarni and Purohit have undergone scientific tests like brain mapping, polygraph and narco-analysis.

Eight persons are presently in judicial custody till November 17 and Purohit is in police custody till November 15.

The ATS on Thursday obtained the custody of religious leader Dayanand Pandey alias Sudhakar Dwivedi from a Lucknow court.

Pandey is accused of having attended several meetings prior to the Malegaon blast along with Lieutenant Colonel Prasad Purohit and other accused in Nashik and Madhya Pradesh.

Pandey, head of Sharda Sarvagya Peeth in Jammu, was picked up by the ATS yesterday and was quizzed on charges of murder, conspiracy and various sections of the Explosives Act.

A team from the ATS may visit Jammu and Kashmir to probe Pandey's activities in that state.

NASHIK/MUMBAI: Self-proclaimed seer Dayanand Pandey alias Sudhakar Dwivedi had directed Lt-Colonel Shrikant Prasad Purohit to arrange for

explosives. Pandey had also arranged a meeting between Purohit and wanted accused Ramji in August this year, a month before the Malegaon blast, public prosecutor Ajay Misar told a Nashik court on Friday. ( Watch )

Pandey, who styled himself as a shankaracharya, Swami Amritanand Dev Teerth Maharaj, was arrested from Kanpur on Thursday for his alleged role in the September 29 Malegaon blast that killed six and injured 101. He was produced before chief judicial magistrate H K Gantra who remanded him in police custody till November 26.

The court also granted permission to subject Pandey to narco analysis, brain-mapping and polygraph tests after he said he was ready to undergo any test.

‘‘During their investigations, the police have found that Pandey had directed Purohit to arrange for explosives,’’ Misar told the court. The police alleged that Purohit was involved in the conspiracy of the Malegaon blast.

Purohit is the first serving officer to be arrested in this case. So far the anti-terrorism squad (ATS) has arrested 10 persons including retired Major Ramesh Upadhyaya and sadhvi Pragya Singh Thakur.

Pandey is believed to have told ATS sleuths that he had joined the Air Force wing of the NDA in 1989 but dropped out in 1990. The police claimed to have recovered a boarding pass of Kingfisher Airlines, a cheque book, a pass book, an ATM card, a debit card, a passport and a pen drive from Pandey. Cops are scrutinising the pen drive’s contents and bank account details.

The Anti-Terrorism Squad (ATS) said it has figured out how Lt Col Shrikant Prasad Purohit had procured RDX used in the Malegaon blast. The ATS also revealed that some of the accused had drafted a plot to kill a prominent Delhi-based Hindu activist and identified a Madhya Pradesh-based Hindu leader, who was allegedly involved in the October 2007 Ajmer blast.

''After the arrest of Purohit and Dayanand Pandey, we have adequate evidence to establish not only their involvement but also the vital role played by Pragya Singh Thakur in the Malegaon blast,'' a senior IPS official told TOI on Friday.

He said Purohit had admitted that he procured RDX from Pune-based Muslim activists and then handed it over to pro-Hindu activists.

''It appears that Purohit used his own network for procuring RDX. We have identified all the persons involved in providing RDX to Purohit. It was also found that the youth have contacts in Kashmir. We will book them in a day or two,'' the IPS official said. It was revealed that some of the accused had drafted a plot to eliminate a Delhi-based Hindu leader. ''We were stunned to know about the plot. We have already shared the information with the authorities in Delhi,'' he said.

The ATS also has information that a Hindu leader from MP was allegedly involved in the October 2007 Ajmer blast. ''The accused told the ATS about the Ajmer blast. They have disclosed the name of the activist, he was murdered six months ago,'' the official said.

On the role of Pandey, the official said he came under the scanner nearly 20 days ago following information disclosed by Pragya and other accused.

''After it was confirmed that he too played a key role in the Malegaon blast, we detained him in Kanpur,'' he said. The IPS officer made it clear that while no elected representative has been involved in the blast, it was a fact that prominent religious leaders were directly or indirectly associated with the blast. ''We have identified two prominent pro-Hindu leaders. We are monitoring their activities and they will be detained at the appropriate time,'' he said.

NASHIK: Police claim to have recovered a pass book belonging to Dayanand Pandey. The bank account, they said, will help them to ascertain Pandey’s financial transactions.

Talking about funding in the terror strike in Malegaon case and other money transactions, Misar added, ‘‘Ajay Rahirkar, treasurer of the Abhinav Bharat outfit, had given a huge amount money to Pandey and we want to establish whether it was used to procure RDX, explosives and timers used in the blast.’’

The police claimed to have recovered two unused timers from the other accused, Shamlal Sahu and Shivnarayan Singh. Pandey was brought to the court at 3.40 pm under heavy police bandobast. Wearing a khadi kurta and a lungi, Pandey, whose face was covered with a black burqa, spoke in fluent Hindi in court. He protested that his name was not Pandey but Sudhakar Dwivedi.

The public prosecutor stated in the court that Pandey attended several ‘confidential meetings’ conducted on April 12, 2008 at Bhopal, another meeting on January 26, 2008 in an ashram in Faridabad. ‘‘Pandey also attended an important meeting prior to the Malegaon blast in Pune,’’ Misar said. According to the police, the conspiracy for the Malegaon blast was hatched in these meetings conducted in several part of the country. ‘‘Pandey had arranged a meeting between Purohit and the prime accused, Ramji in August this year,’’ said Misar.

He told the court Ramji was yet to be arrested. ‘‘We want to know Ramji’s exact role in planting the bomb. The arrest of Ramji and another wanted accused Sameer Dange will help in the investigation. We have to locate Ramji for which we want Pandey’s police custody. We also want to find out if Pandey had any role to play in various other blasts across the country,’’ said the public prosecutor.

Pandey was also in constant touch with sadhvi Pragya Singh Thakur, who is now in judicial custody. Her motorbike was used to plant the bomb. The ATS has claimed to have in its possession telephonic conversations between Ramji and Pragya where she asks him why only a few people died in the Malegaon blast. The ATS had earlier said that three accused, now in police custody, were fund raisers and collected money which was used in the Malegaon terror strike.

NASHIK: Priest Mahant Amritanand alias Dayanand Pandey, arrested from Kanpur for his alleged involvement in the Malegaon blast, was on Friday remanded in police custody till November 26.

The prosecution also sought permission to conduct polygraph, narco-analysis and brain mapping tests on Pandey which was granted by joint civil judge H K Ganatra.

Pandey, who was produced before the judge, complained of being physically assaulted by officials of the Anti- Terrorism Squad.

On Thursday, he was remanded in ATS custody by a Lucknow court following his arrest on Wednesday.

The court then took him in chambers to examine for injury marks. However, none was found.

The prosecution argued Pandey is accused of having attended meetings held in Bhopal, Pune and Faridabad prior to the September 29 Malegaon blast and also claimed he played a key role in making the bomb used in the strike.

The meetings were allegedly attended by other arrested persons in the case including army official Lt Col Prasad Purohit.

Another arrested accused from right wing organisation Abhinav Bharat, Ajay Rahirkar, had allegedly transferred large amounts of money to Pandey, prosecution counsel Ajay Misar said.

The ATS suspects the money was sent for purchase of RDX and detonators used in the blast, Misar said.

LONDON: An illegal immigrant from India is among four people arrested by UK Border Agency officials from a restaurant in northern England.

The four men were taken into custody from the Kebabish Original restaurant in Middlesbrough by the Cleveland Police yesterday in a joint operation with officials from the UK Border Agency.

Restaurant owner Humran Pervez, 30, claimed that he had no idea that the four men might be working illegally. However, he is expected to face prosecution since it is against the law to employ illegal immigrants.

A spokeswoman for the UK Border Agency said: "We can confirm it was a joint police and UK Border Agency intelligence operation and two Pakistani nationals, one Indian national and one Afghan national were arrested.

"The arrests were made by police and they were handed to Border Agency officials. A notice of potential liability was served on the employer.

"He could face two years in jail and/or up to a pounds 10,000 fine for each individual he has employed knowingly. Even if he employed them unknowingly, but failed to carry out the proper checks, he could be liable."

Pervez told the local media: "When they started working for me I asked for all their documents and they produced them - I checked everything out and took them on thinking they were legal. I'm shocked by what has happened."

Since tough new rules were introduced in February 2008, over 1,000 fines worth around 9.7 million pounds have been issued to employers, who employed people did not have permission to work in the UK.

Children’s Day. The Additional District Sessions court in Thalassery on Friday convicted 13 BJP-RSS workers for the murderous attempt on her in 2000. The verdict will be declared on Monday. Daughter of a teashop owner, six-year-old Asna was playing in front of her house in her village in September 2000 when a bomb thrown by an RSS worker fell near her. She lost her right leg in the attack and she has been walking on a Jaipur foot ever since. The bomb was hurled during a clash between RSS and CPM workers following allegations of snatching of ballot boxes in a local panchayat election. The court found the BJP-RSS workers guilty on various counts, including bomb-making and attempted murder. One of the defendants was killed just a few days ago when the bombs that were either being made or being shifted went off accidentally. “This verdict will be a deterrent for all those who are concerned about the bomb culture and political killings in Kannur,’’ said prosecutor C K Sreedharan said.

Two years ago, CPM workers who butchered a primary schoolteacher in front of his students in a classroom were let off by the court for want of evidence. The accused later declared in public that they were ready to commit the crime again against the “class enemies”. At least 200 men have lost their lives in revenge killings between the CPM and the BJP-RSS combine in the district during the past three decades.

Indian-American pleads guilty to $33m fraud

NEW YORK: Indian-American Vijay K Taneja, popular in the community for his mega Bollywood shows in the US, has pleaded guilty to a massive $33 million mortgage fraud, the Federal Bureau of Investigation (FBI) has said. ( Watch )

The money was apparently used to fund Taneja's Bollywood ventures, including investment in several films, the investigating agency said Thursday.

The US district court in Alexandria has scheduled the sentencing in the case for January 30. A resident of Fairfax, Virginia, Taneja faces 20 years of incarceration and a fine of $500,000, which is the penalty for conspiracy to commit money laundering.

FBI said Taneja, 47, was involved in a massive mortgage fraud scheme through his company Financial Mortage Inc (FMI), which originated and sold mortgages on residential properties in and around the Washington area.

A large number of Indian-Americans in and around Washington area have been a victim of his mortgage fraud.

According to court documents in support of the guilty plea, before FMI sold its mortgages to financial institutions as long term investors, it utilised another group of financial institutions to temporarily fund the mortgages before they were sold.

Beginning in 2001, FMI began defrauding a series of warehouse lenders and eventually two other financial institutions serving as long term investors, causing an accumulated loss of at least $33 million to four financial institutions by the time FMI filed for bankruptcy in June 2008, the FBI said.

The financial institutions included First Tennessee Bank, Franklin Bank, Wells Fargo Bank, and EMC Mortgage Corporation, a wholly owned subsidiary of JP Morgan Chase & Co.

FBI said Taneja accomplished the mortgage fraud scheme by creating fictitious loans with bogus loan closings, selling the same legitimate loan to multiple investors, and pocketing the proceeds generated from refinancing loans, when the bulk of those proceeds were intended to pay off prior mortgages on the same properties.

Court documents state that for at least part of the scheme, Taneja conspired with the owner of TitlePro, a Fairfax title company. The company went out of business in May, 2008, FBI said.

In a report, The Washington Post said prosecutors told the judge that Taneja invested millions of his mortgage proceeds in Indian films and theatrical productions through one of his companies Elite Entertainment. The details are still being investigated.

"He has millions of dollars unaccounted for. There's so much money, and it's difficult to figure out where it all went," Assistant US Attorney Stephen was quoted as saying.

TORONTO: A Hindu man, who came to Canada in 1998 on fake papers and lied about his links to Babbar Khalsa to seek refuge on grounds of religious persecution in India, is in double trouble.

Because of his lies, he now fears both the Indian government and Babbar Khalsa.

Forty-two-year-old Baljit Ram told the Vancouver Sun Monday that he is a Hindu and lied about his religion to support his case against deportation to India.

He said he was told by his advisers to pretend to be a Babbar Khalsa member to persuade the Canadian authorities to grant him refugee status.

However, his case was rejected and he was ordered to be deported in 2000.

But Ram went underground and was noticed only this September when he was found stabbed at a subway station in Surrey on the outskirts of Vancouver.

On verification, police found that he had been ordered to be deported to India eight years ago, and that he also had an arrest warrant pending against him.

"I am Hindu," Ram was quoted as saying by the Vancouver Sun.

Like many Indians who land in Canada on fake papers and later seek refugee status citing persecution in India, Ram said he also lied to the Canadian authorities about his membership of Babbar Khalsa which is banned in India and Canada.

"First time I come, I lie and say I was Babbar Khalsa member. I wanted to stay here so I lied. Everybody who comes here, first day, everybody lie (and) say Babbar Khalsa party member or other story like this. I don't know Babbar Khalsa. I know nothing," he told the newspaper.

The newspaper wondered why the arrest warrant against Ram was issued only this January when he should have been deported in 2000.

The warrant document also identified him as a Babbar Khalsa member.

Pleading to be allowed to stay in Canada, he said, "If I go to India, I have problems. Police there (might) say, 'Hey you were lying there. Maybe you are a Babbar Khalsa member. Maybe (the) Babbar Khalsa party give me problem."

However, the newspaper quoted his lawyer as saying that Ram had claimed links to Babbar Khalsa while seeking review of his deportation order.

Ram said he has been living on allowances given by friends and a gurdwara for the past eight years. But the gurdwara has denied any links to him.
