 A year after the Tri Valley university scam left several students from India high and dry, another American varsity with a significant Indian population, has run into trouble after its CEO was charged with visa fraud. Jerry Wang, 34, the CEO of Sunnyvale California-based Herguan University and the University of East-West Medicine has been charged in a San Jose District Court with a 15 count indictment on visa fraud including that he forged federal documents to allow foreign students to enter and stay in the US. Federal agents raided the Herguan University in California and arrested Wang on Thursday. Wang faces a maximum penalty of up to 85 years in prison if convicted of all charges. He could also have to pay a fine of up to a million dollars.
Wang's father and mother have also been named in the 10-page indictment, which alleges that between 2007 and 2011, they submitted false transfer letters and forged other visa documents required for non-immigrant students to the US Department of Homeland Security's Student and Exchange Visitor Programme (SEVP).
The Wangs collected tuition fees and other payments from Herguan students in exchange for maintaining their false student visa records.
The case could spell trouble for the about 450 students of Herguan, most of whom are from India. A photograph on the university's website shows some graduating students, half of whom are Indians.
The university however wrote on its website that the charges against Wang have not affected Herguan and that Wang has resigned from his post.
The university is "open and and conducting classes as usual. Government charges against the Designated School Official, who has resigned, regarding immigration issues, have not affected the University. Students will find classes scheduled as usual," it said.
The university added that if students have valid visa status "nothing has changed for you."
The university is seeking Wang's replacement and has appointed Doreen Simmons as the Interim Chief Operating Officer.
The US Immigration and Customs Enforcement (ICE) said in a statement that in light of the allegations, Herguan and the University of East-West Medicine could lose authorisation to enroll foreign students.
"Foreign students who are currently enrolled at these universities may continue to attend classes as long as the schools remain SEVP-certified and the students are able to maintain their lawful immigration status," ICE said.
The ICE has issued both schools a Notice of Intent to Withdraw, the first step in revoking the schools' SEVP certification.
The universities have 30 days to respond to the notice and request an interview to contest the action. The indictment charges Wang with conspiracy to commit visa fraud; use of false documents; aggravated identity theft; and unauthorised access to government computers.
Wang made his initial appearance in federal court on Thursday and is scheduled to be formally arraigned August 20.
The school offers computer science and business degrees and was granted federal approval in 2008 to accept foreign students.
The San Jose Mercury News quoted a Herguan graduate Rajiv as saying that the news of the raid came as a shock. He said foreign students were told if "that in the next 15 days, if something doesn't change, you either have to find a different school or leave the country."
Last year over 1000 Indian students were affected by the Tri-Valley scam after the university was raided and shut down by authorities on charges of a massive immigration fraud.
Many students had faced the threat of deportation to India after the scam was uncovered. Federal authorities had alleged that Tri valley had been paid millions of dollars by foreigners to obtain student visas that authorised them to remain in the US.

No American goes there. These places are solely for the purpose of maintaining student visa. The students enrolled there usually are from third world countries, and do odd jobs at gas stations and restaurants. Besides 90% telugu this university also has 10% other people. Let us digest some some reality which is a fact and not caste based. Why does this happen more with telugu people?. beacause they have a social pressure to be in the USA. If one from a family is not in USA then they are considered useless.That's why so many undeserving people prepare fake degrees and give a shot to such cheap universities. And FYI there are many universities in USA which are cheaper that this fake univ. But unfortunately they are legitimate and clean and so difficult to enter with fake documents

If I were to guess, out of the 450 odd Indian student, 420 students would be from Andhra Pradesh (pun intended). Not just in obtaining visa via fraudulent means, from of the AP folks break almost all barriers of law while in US, from working illegally to using fake resumes to get job. The USCIS needs to wake up and do a good job of filtering such scam stars from India

Seems like Jerry Wang 34 perhaps Chinese origin, the CEO of the so called Sunnyvale California-based Herguan University has replaced by the white American Doreen Simmons for the dirty business to run and to make fool of the people of India and elsewhere. Most of this kind of universities in America , Australia and Europe are just doing their business and the mostly the student who knows that through these visas are just going there for cheap labour to cleaning jobs,wash dishes. working in gas stations or fast food restaurants etc

The US universities thrive because of asian students wanting to get educated. In many cases students who cannot get through JEE or get good scores in GATE go to US for an education. Scoring in TOEFL or GRE is far easier than cracking JEE or GATE. So any dammed US university is enough. It is not that everybody gets into top ranked universities like Harvard or MIT.

India has 1.3 billions people living in India. In USA they have over 300 millions people living and USA is only 300 years old nation where just 100 years ago they had slaves nothing more. India could build many thousands of university and colleges to educate it population and few millions more of this foreigners students. Why India has to pay billions per year to USA? I educated myselfin India and can never dream to travel to educate myself because India has lot to offer to everyone so why Indians are mad going into this narrow minded racist countires to live and to educate. Go on holiday and find out how their native people living and suffering and look at this recession beyond belief where their own citizen are living in slum just like our cities and crime is beyond belief too. Now India should develop in this field and stop bagging in foreign land so students of India do not have to suffer racism as such. wake up India and stand up now

AP students left in the lurch as US varsity comes under lens HYDERABAD: While the future of around 400 students from the state studying at the Californian Herguan University hangs in limbo, the government is yet to establish contact with the Indian Embassy in San Francisco. Educational consultants said chances of these students getting a transfer in other varsities were also slim. On August 3, CEO of Herguan University Jerry Wang, was charged with various counts of visa fraud leaving the careers of students from the city in a precarious balance. Government officials said that they have had no contact with embassies or students and their families and are keeping their fingers crossed. Ramana Reddy, special secretary in charge of NRI affairs, said, "No representation has been made so far. It is high time to establish contact with India Embassy in San Francisco. We are hoping for a development soon so that we can help the students." Sources said that the 'dubious' Herguan University was already on US authorities' scanner and that an incident at the now-tainted varsity was predicted much earlier. They noted that none of the students from the state had applied to the university from the country but in fact had sought a transfer from state universities after being lured by a full time work permit and a low tuition fee. They added that the prospects of seeking a transfer from Herguan University to other varsities were bleak. Surya Ganesh Valmiki, CMD, Valmiki Group of Overseas Educational Consultants, said, "It is likely that credits of students from Herguan University will not be accepted elsewhere because of the incident. However, the Department of Homeland Security will decide the deadline and transfer of these students. The fee for such universities is $5,000 as against $15,000 to $20,000 charged by reputed institutions. Therefore, to both save and make money, students rush to study at such places." Sources said that of the 1.5 lakh students who rush to foreign shores, 60% are from the state. They added that many unaccredited institutions like Herguan offered students a full-time work permit instead of the 20-hour a day work permit which is why students go there. While most students finish their course in two years, they opt for an F1 visa, a five-year multiple entry visa. M Madhavi from i20 Fever said that it was quite likely that the students would be asked to return.
